The protection of indigenous rights in the jurisdiction of Human Rights Committee

Tematem pracy jest ochrona praw ludności rdzennej w orzecznictwie Komitetu Praw Człowieka. Pierwszy rozdział przedstawia aktualną sytuację ludów rdzennych na świecie oraz podstawy teoretycznoprawne ochrony zagwarantowanych jej praw. W drugim rozdziale przedstawiono dotychczas wypracowane rozwiązania w kwestii definicji praw rdzennych oraz umowy międzynarodowe w kwestii praw ludów rdzennych stworzone w systemie Organizacji Narodów Zjednoczonych. W rozdziale trzecim analizowane jest orzecznictwo Komitetu Praw Człowieka w kwestii praw ludów rdzennych w poszukiwaniu odpowiedzi na pytanie czy mechanizm stworzony w ramach Międzynarodowego Paktu Praw Obywatelskich i Politycznych i Protokołu Fakultatywnego z 1966 roku jest wystarczającym narzędziem ochrony praw ludów rdzennych.

The primary purpose of the following thesis called "The protection of indigenous rights in the jurisdiction of Human Rights Committee" is to determine how broadly the mechanism based on The International Covenant on Civil and Political Rights and The First Optional Protocol protects the rights of indigenous peoples guaranteed in UN system. The first chapter presents the current situation of the indigenous peoples and the jurisprudential basis for their protection. The second chapter shows the effort to create a universal definition of the indigenous peoples and the regulations concerning indigenous rights created in the UN system. The third chapter analyses the jurisdiction of the Human Rights Committee in the pursuit of the answer to the question if the mechanism mentioned above provides enough protection to indigenous peoples.
