The document form in the Civil Code

Przedmiotem pracy licencjackiej jest forma szczególna czynności prawnej, jaką jest forma dokumentowa. Regulacja formy dokumentowej weszła w życie w dniu 8 września 2016 roku. Jest to forma czynności prawnej o najmniejszym stopniu sformalizowania. W pracy licencjackiej zostały omówione: ogólne informacje o formie czynności prawnej, przyczyny wprowadzenia regulacji formy dokumentowej do Kodeksu cywilnego, wymagania formy dokumentowej ze szczególnym uwzględnieniem: problematyki dokumentu, sposobu złożenia oświadczenia w formie dokumentowej oraz kwestii identyfikacji osoby składającej oświadczenie. Kolejno przedstawiono problematykę rygoru niezachowania formy dokumentowej jak również zastosowania formy dokumentowej w kodeksie cywilnym. W podsumowaniu zawarto ocenę wprowadzonej regulacji formy dokumentowej.

The subject of the thesis is a form of the acts in law, which is the document form. The regulation of the document form entered into force on September 8, 2016. It is a form of the acts I law with the least degree of formalization. The thesis discussed: general information about the form of acts in law, the reasons for introducing the regulation of the document form to the Civil Code, the requirements of the document form with particular emphasis on: document issues, how to submit a statement in document form and the issue of identifying the person making the statement. The issues of the rigour of not maintaining the documentary form as well as the use of the documentary form in the Civil Code have been presented in turn. The summary includes an evaluation of the introduced regulation of the document form.
