Restrictions of trade in "hospital" receivables

Niniejsza praca magisterska ma na celu omówienie regulacji ograniczającej obrót wierzytelnościami SPZOZ zawartej na początku w ust. 6 i 7 art. 53 ustawy o zakładach opieki zdrowotnej, a potem w obowiązujących do dnia dzisiejszego ust. 5 i 6 art. 54 ustawy o działalności leczniczej. W pracy tej opisanie zostały problemy natury interpretacyjnej, które towarzyszyły przedmiotowej regulacji, ze szczególnym naciskiem na cywilistyczny aspekt tej problematyki oraz ewolucję orzecznictwa

The aim of this Master's thesis is to discuss the regulation restricting the trade in SPZOZ receivables contained, at the beginning, in sections 6 and 7 of Article 53 of the Act on Health Care Institutions, and then in sections 5 and 6 of Article 54 of the Act on Medical Activity, which are still in force today. The paper describes the problems of interpretation nature that accompanied the regulation, with particular emphasis on the civil law aspect of this issue and the evolution of jurisprudence.
