The issue of application of the Enfranchisement Act of October 26, 1971 in the light of regulations in effect.

Celem niniejszej pracy jest przedstawienie najważniejszych problemów prawnych związanych ze stosowaniem ustawy uwłaszczeniowej z dnia 26 października 1971 r. Ustawa ta miała na celu uporządkowanie skomplikowanych stosunków własnościowych, w sposób generalny i powszechny. Została ona uchylona w 1982 r., a prowadzenie spraw niezakończonych przekazane zostało do właściwości sądów. Proces porządkowania zakończony został ostatecznie ustawą z dnia 19 października 1991 r. o gospodarowaniu nieruchomościami rolnymi Skarbu Państwa. Wprowadziła ona zakaz stosowania nadzwyczajnych procedur weryfikacji przewidzianych w Kodeksie postępowania administracyjnego w stosunku do wszelkich decyzji ostatecznych wydanych na podstawie ustawy uwłaszczeniowej. Wprowadzenie tych regulacji spowodowało wiele rozbieżności zarówno w doktrynie przedmiotu jak i orzecznictwie.

The purpose of this thesis is to present the most vital issues related to the use of the enfranchisement Act of October 26, 1971. This act’s goal was to bring order into complex and complicated ownership relations which occured in Poland at that time in a general and holistic manner. The Act in question has been repealed in 1982 and cases started while the Act was in force were transferred to be recognized by courts. The proces of resolving the issues related to the ownership of land in Poland has ulitmately been completed by introducing the Act on Management of Agricultural Property Stock of the Treasury from 19 October, 1991 which forbid the possibility of verification of final administrative decisions issued based on the enfranchisement Act. Introducing mentioned law has caused discrepancies challenged by Jurisprudence and representatives of the legal doctrine.
