The phenomenon of 'desaparecidos' in the contemporary Latin America.

Praca magisterska porusza temat zjawiska wymuszonych zaginięć, które jest wciąż istniejącym problemem większości państw Ameryki Łacińskiej. Jest to zarówno efekt naruszeń praw człowieka mających miejsce w latach 80. i 90. ubiegłego wieku, jak również problem wynikający z wszechobecnego zjawiska przemocy, które pojawiło się i wzrasta w ostatnich latach. Celem pracy magisterskiej jest przedstawienie oraz zbadanie problemu wymuszonych zaginięć we współczesnej Ameryce Łacińskiej, zarówno pod względem skali zjawiska jak i miejsc występowania. Analiza ma przedstawić powody naruszeń, typologię ofiar i sprawców, środki prawne podejmowane przez państwa regionu oraz efekty ich działań. Praca składa się z czterech rozdziałów, które odpowiednio przybliżają problematykę zagadnienia zarówno na poziomie globalnym, jak i regionalnym. Ze względu na złożoność przedstawianego tematu, rozdział pierwszy w całości poświęcony jest operacjonalizacji pojęcia wymuszonego zaginięcia, wyjaśniając jednocześnie historię powstania i rozwoju zjawiska, a także proces jego penalizacji. Ukazano również następstwa zjawiska szczególnie ważne dla regionu jak problem dzieci desaparecidos oraz ich bliskich i rodzin. Kolejny rozdział porusza kwestie prawne związane ze zjawiskiem zarówno na poziomie krajowym jak i międzynarodowym. Autorka przedstawiła tu także instytucję Międzyamerykańskiego Trybunału Praw Człowieka oraz wskazała na najważniejsze orzecznictwo wydane przez organ w sprawie przestępstwa wymuszonych zaginięć. Rozdział trzeci opisuje zjawisko wymuszonych zaginięć w Ameryce Łacińskiej na wybranych przykładach: Argentyny, Meksyku i Peru. Dalsza część dotyczy zapobiegania zjawisku, a także jego wpływowi na społeczeństwa latynoskie. Ze względu na istnienie dużej liczby organizacji zajmujących się problemem, autorka skupiła się na tych najważniejszych i porównała ich działania oraz rezultaty, zarówno na poziomie globalnym jak i regionalnym.

This paper treats about the phenomenon of enforced disappearance occurring in the contemporary Latin America. This is an effect of both the violations of human rights in Latin America in the 1980s and 1990s and problem resulting from the widespread violence that emerged and continued increasing in the recent years. The main aim of this work is to analyze and demonstrate the scale of the problem, both in terms of the magnitude and the scope of these activities. Moreover, the review of the perpetrators, their motives, and the implementation of the protective measures by the authorities of Latin American countries will help to answer the question of the severity of these violation. The paper consists of four chapters, which bring focus to different aspects of the enforced disappearance in the regional and global level. The first chapter shows the operationalization of notion ‘enforced disappearance’, its history, development and crucial process of its criminalization. Furthermore, the chapter discusses the results of the phenomenon particularly important for the region, such as situation of the children of desaparecidos, their relatives and families. The second part is an attempt to show the basic legal issues linked to the phenomenon, both at national and international level. The author introduced the institution of Inter-American Court of Human Rights, indentifying its most important jurisprudence related to enforced disappearance. The next chapter describes the scope of the problem in the region. It focuses on the situation in Argentina, Mexico and Peru. Finally, the last chapter is an attempt to answer the question about the influence of the phenomenon on Latin American societies on the basis of the analyzed reports. Moreover, it includes the most important regional and international organizations that support the victims of this violation. It also shows their actions and results, both at national and regional level.
