Pierwszy rozdział pracy stanowi historyczne ujęcie powstania i rozwoju koncepcji odpowiedzialności odszkodowawczej władzy publicznej. Autor ukazuje w nim kluczowe zdarzenia stanowiące cezury kształtowania tej idei, wpływające na obecny sposób jej postrzegania. W rozdziale drugim autor zwraca uwagę na interpretacyjne spory powstałe na gruncie zasady odpowiedzialności odszkodowawczej państwa zamieszczonej w Konstytucji Rzeczypospolitej Polskiej z 1997 roku. Następnie wskazuje konsekwencje wynikłe z umieszczenia owej zasady w akcie rangi konstytucyjnej. Trzeci rozdział stanowi wskazanie i analiza przesłanek odpowiedzialności odszkodowawczej władzy publicznej ujętych w regulacji konstytucyjnej. Autor prezentuje różnice i podobieństwa na gruncie konstytucyjnym i prawnocywilnym rozumienia zasadniczych pojęć nadających kształt zasadzie odpowiedzialności, takich jak: szkoda, bezprawność, działanie niezgodne z prawem, organ władzy publicznej, związek przyczynowy.

The first chapter of the paper is a historical view of the origin and development of the concept of liability of the public authority. The author shows in it the key events shaping this idea, influencing the present way of perceiving it.In chapter two, the author pays attention to the interpretative disputes arising from the state’s compensation liability principle placed in the Constitution of the Republic of Poland from 1997. Subsequently the author highlights the consequences created as a result of placement the principle in the act of constitutional status.The third chapter is an indication and analysis of the conditions for the liability of the public authority included in the constitutional regulation. The author presents the differences and similarities on the basis of constitutional and civil law for the understanding of essential concepts that shape the principle of liability, such as: damage, unlawfulness, unlawful activity, public authority, casual nexus.
