Celem niniejszej pracy jest analiza dopuszczalności i ewentualnych skutków prawnych wyroków Trybunału Konstytucyjnego podejmowanych w formie interpretacyjnej. Wyroki interpretacyjne Trybunału Konstytucyjnego to takie orzeczenia, które w sentencji przewidują określony sposób rozumienia kwestionowanego przepisu (normy), przesądzając jednocześnie o jego konstytucyjności bądź niekonstytucyjności. Praca składa się z trzech rozdziałów. Rozdział pierwszy opisuje główne typy wyroków wydawanych przez polski sąd konstytucyjny, ze szczególnym uwzględnieniem charakterystyki wyroków interpretacyjnych. W rozdziale tym przeprowadzona jest także analiza ich dopuszczalności oraz przedstawione możliwe sposoby klasyfikacji, jak również wykazanie podstawowych różnic między nimi, a wyrokami zakresowymi. Rozdział drugi koncentruje się na przedstawieniu warunków wydawania wyroków w formie interpretacyjnej, ich zakresu przedmiotowego oraz zawiera rozważania ma temat możliwego niewłaściwego zastosowania formuły interpretacyjnej przez Trybunał Konstytucyjny. W rodziale trzecim omówione zostają skutki wyroków polskiego sądu konstytucyjnego, a szczególna analiza dotyczny skutków wywoływanych przez wyroki interpretacyjne. Rozdział ten zakończony jest analizą i oceną orzecznictwa sądów, głównie Sądu Najwyższego.

The aim of this study is the analysis of permissibility and potential legal consequences of the interpretative judgments of the Constitutional Tribunal. Interpretative judgments of the Constitutional Tribunal are judgements, in the sentence of which they include a certain interpretation of the challenged legal regulation (norm), and forejudge their constitutionality or unconstitutionality. The study consists of three chapters. The first chapter describes main types of judgements issues by the polish constitutional court, with a deeper analysis of interpretative judgments. This chapter considers also the permissibility of the latter type of judgements and potential ways of their classification, as well as indicates main differences between them and limited judgements. The second chapter concentrates on presentation of conditions required for issuing of interpretative judgments, their material scope and contains considerations around potential incorrect usage of the interpretative formula. The third chapter describes legal consequences of polish constitutional court judgements, while a deeper analysis focuses on the interpretative judgments. This chapter is ended with an analysis and evaluation of other polish courts’ judgements, mainly judgements of the Supreme Court.
