Nuisances as an influence on a neighbouring land

Praca przedstawia immisje, jako oddziaływanie będące nieodzownym elementem życia sąsiedzkiego. W początkowej części pracy zostaje wyjaśniona definicja immisji, a następnie poruszone zagadnienie prawa sąsiedzkiego oraz sąsiedztwa nieruchomości. W dalszej części omówiono i opisano podział zagadnienia na poszczególne typy tj. bezpośrednie i pośrednie, pozytywne i negatywne, a także materialne i niematerialne. Zwrócono uwagę także na odróżnienie immisji od wtargnięcia. Następnie opisano tematykę związaną z unormowaniami dotyczącymi tematu, przedstawiając także takie zagadnienia jak społeczno-gospodarcze przeznaczenie nieruchomości oraz stosunki miejscowe. Zamieszczono także opis przeciętej miary zakłóceń oraz dopuszczalnych oddziaływań. W końcowej części pracy znalazła się prezentacja roszczeń przysługujących w ramach obrony przeciw nadmiernymi lub zbyt uciążliwymi immisjami. W tej części poruszono także temat szkody. Praca została napisana w oparciu o Kodeks cywilny, orzecznictwo sądowe oraz literaturę fachową z dziedziny immisji.

This assignment shows nuisances as an influence which is an indispensable element of living in a neighborhood. The beginning part of this dissertation explains the definition of a nuisance, in later part the different types of nuisances was described, namely direct and indirect positive and negative and also substantial and non-substantial. The attention was also drawn to the difference between a nuisance and a trespassing. Next was the subject description about the normalization about the topic, presenting such issues as socio-economical predestination of properties and the local relations. There also was attached a description of common scale of interruption and permissible influences. The final part of this assignment also contains a presentation of pretensions which are entitled in case of defense against exaggerated or too burdensome nuisances. In this part also the issue about the subject of a loss was raised. This dissertation was based on the civil code, case-law of the court, and a specialist literature of the nuisance branch.
