Court division of the community marital property in the Polish Civil Procedure

Przedmiotem niniejszego opracowania jest problematyka sądowego postępowania w sprawach o podział majątku wspólnego małżonków. Zagadnienie to zostało uregulowane na zasadzie podwójnego odesłania. Artykuł 567 § 3 k.p.c. zawiera odesłanie do przepisów dotyczących postępowania o dziale spadku, w których z kolei znajduje się odesłanie do przepisów dotyczących zniesienia współwłasności. Taka regulacja jest konsekwencją uregulowań prawa materialnego traktującego o majątku wspólnym małżonków, gdzie również znajdują się odesłania do przepisów dotyczących działu spadku i zniesienia współwłasności. Takie podwójne odesłanie prowadzi do sytuacji, w której wiele zagadnień i problemów ma charakter złożony i sporny. W pracy zostały omówione normy dotyczące postępowania rozpoznawczego nieprocesowego, które w zakresie postępowań o podział majątku wspólnego małżonków mają zastosowanie na zasadzie lex generalis. Przedstawiono również normy szczególne regulujące postępowanie o podział majątku wspólnego małżonków, koncentrując się na statyce tego postępowania. W opracowaniu znajduję się również rozdział poświęcony omówieniu norm materialnoprawnych dotyczących małżeńskich ustrojów majątkowych oraz skutków prawomocności orzeczeń dotyczących podziału majątku wspólnego małżonków.

This master thesis presents issues of court proceedings concerning division of property of the joint spouses. This issue is regulated by the principle of double referral. Article 567 (3) of Polish Code of Civil Procedure contains a reference to the regulations concerning inheritance proceedings, where, in turn, there is a reference to the regulations concerning the abolition of joint ownership. Such a regulation is a consequence of the substantive law regulating the common property of spouses, where there are also references to the rules of division and abolition of joint ownership. Such a double referral leads to a situation where many issues are complex and contentious.There are described standards of non-litigious proceedings which, in the scope of proceedings for division of property of spouses, apply as lex generalis. Also there is included description of specific standards governing the division of property of spouses, focusing on the statics of this procedure. This publication also includes a chapter devoted to discussing the substantive rules governing matrimonial property regimes and the influences on the validity of judgements concerning the division of property between spouses.
