Ruling in cases of people with disabilities

Prawne pojęcie niepełnosprawności umożliwia identyfikację osób dotkniętych dysfunkcją oraz stanowi podstawę realizacji licznych uprawnień, przyznawanych aby niwelować negatywne skutki niepełnosprawności w życiu jednostek. Niniejsza praca składa się z trzech rozdziałów. W pierwszym rozdziale zostanie scharakteryzowane ogólne postępowanie administracyjne ze szczególnym uwzględnieniem instytucji autokontroli. W drugim rozdziale zostaną omówione w szczególności organy orzekające o niepełnosprawności oraz ich tworzenie i likwidowanie, a także ustalenie stopnia niepełnosprawności i wskazań dla celów korzystania z ulg i uprawnieńna podstawie odrębnych przepisów. W trzecim rozdziale zostanie scharakteryzowane orzekanie w sprawach osób niepełnosprawnych przez regionalne zespoły do spraw orzekania o niepełnosprawności, odwołanie od decyzji tych zespołów, jak i kompetencje nadzorcze Pełnomocnika do Spraw Osób Niepełnosprawnych.

Legal aspect of disability allows the identification of people affected by the dysfunction and is the basis for the implementation of numerous entitlements, granted to help mitigate the negative effects of disability in the lives of individuals. This thesis consists of three chapters. In the first chapter, a characterization of the administrative proceedingsin general will be carried out with special emphasis on the institution of self-auditing . In the second chapter, the organs ruling in the matter of disability, their creation and liquidationin particular will be discussed, as well as determination the degree of disability and indications for use of reliefs and allowances on the basis of separate regulations. In the third chapter will be characterized ruling in cases of people with disabilities by the regional bodiesfor issues of disability, appeal against the decision of these organs and supervisory powers of thePlenipotentiary for Persons with Disabilities.
