The limits of the autonomy of the patient when granting consent to medical action

Niniejsze opracowanie stanowi próbę analizy stopnia autonomii, jakim dysponuje pacjent w zakresie realizacji przysługującego mu prawa do wyrażenia zgody na zabieg medyczny. Rozważania koncentrują się wokół kwestii, czy polskie prawo zapewnia należyte poszanowanie prawa jednostki do samostanowienia w relacjach medycznych, realizując równocześnie postulat wzmożonej ochrony praw pacjenta jako strony słabszej i gorzej zorientowanej. Pracy został nadany taki układ, by najpierw ukazać ewolucję pojmowania relacji pacjenta z lekarzem oraz moralne i etyczne podstawy zasady szacunku dla autonomii. Następnie omówione zostały niektóre akty prawa międzynarodowego, proklamujące prymat prawa pacjenta do samostanowienia, a także zasady konstytucyjne o istotnym dla omawianej problematyki znaczeniu. Stanowi to punkt wyjścia dla dalszej lektury, w ramach której zaprezentowano zagadnienia związane z realizacją autonomii pacjenta w procesie uzyskiwania zgody na czynność lekarską, ze szczególnym uwzględnieniem obowiązku należytego poinformowania pacjenta jako warunku ważności udzielonej przezeń zgody. Na koniec przedstawiono kwestię oświadczeń pro futuro jako szczególnej formy manifestacji woli pacjenta. Pracę zwieńczono krótkim podsumowaniem, w którym zawarto spostrzeżenia końcowe oraz postulaty de lege ferenda.

This paper is an attempt to analyze the degree of autonomy which the patient has in the implementation of his right to consent to medical treatment. Deliberations revolve around the question of whether Polish law provides the proper respect for the individual's right to self-determination in medical relationships, realizing at the same time the demand for increased protection of patient's rights as the weaker and less-oriented party. Work has been given such a system to first show the evolution of the understanding of the relationship of the patient with the doctor and the moral and ethical foundations of the principle of respect for autonomy. It then discusses some of the acts of international law, proclaiming the primacy of the patient's right to self-determination as well as the constitutional principles essential for the discussed issues. This is a starting point for further reading, in which presented issues related to the realization of the autonomy of the patient in the process of obtaining approval for a medical action with particular emphasis on the obligation to inform patient properly as a condition of validity of the consent to treatment. The paper presents also the issue of advance directives as a particular form of manifestation of the will of the patient. The work ends with a short summary.
