dc.abstract.pl Celem niniejszej pracy było wykazanie zasadności eliminowania spółdzielczego własnościowego prawa do lokalu poprzez porównanie tego ograniczonego prawa rzeczowego z konstrukcją odrębnej własności lokalu, a także poprzez odwołanie się do poprzednich regulacji obowiązujących w tym zakresie. W poszczególnych rozdziałach dokonano szczegółowej analizy obu konstrukcji prawnych. W skrócie przedstawiono również ich ewolucję na przestrzeni lat. Nadto, omówiono prawa i obowiązki podmiotów tychże praw oraz problematykę zarządu nieruchomością wspólną zarówno w sytuacji, gdy w danym budynku nie występują lokale spółdzielcze, jak i w sytuacji, gdy część z nich należy do spółdzielni mieszkaniowej, a część do innych właścicieli. Na koniec zestawiono najistotniejsze różnice, które jak wykazano w niniejszej pracy, na przestrzeni lat stopniowo uległy zatarciu pl
dc.abstract.en The aim of this thesis was to indicate the legitimacy of eliminating cooperative right to premises by comparing this limited property right with the construction of a separate owshership of premises as well as by referring to previous regulations concerned with this field. In individual chapters, a detailed analysis of both legal structures was done. Their evolution over the years was briefly presented. Furthermore, the rights and resposibilities of the subjects of these laws and the issues with common property management were described in scenarios where a building does not posses cooperative units as well as where a part of them belongs to housing cooperative and the rest to the owners. In the end one had presented most significant differences which were shown in this thesis over the years when they gradually had blurred. pl
