Celem pracy jest przedstawienie instrumentów prawnych stosowanych przez prawodawcę w celu reglamentacji działalności gospodarczej związanej z produktem leczniczym. Praca składa się z czterech rozdziałów. Pierwszy rozdział dotyczy pojęcia produktu leczniczego. Poruszono w nim również problematykę produktów z pogranicza. W drugim rozdziale zostały omówione przyczyny ograniczeń prawnych nakładanych przez państwo. W trzecim rozdziale opisano procedury dopuszczenia do obrotu produktów leczniczych, łącznie z instytucjami prawnymi stosowanymi na zasadzie wyjątku, jak na przykład import docelowy. Przedmiotem ostatniego rozdziału jest mechanizm dystrybucji produktów leczniczych, ze szczególnym uwzględnieniem obrotu detalicznego. Rozdział zawiera wymogi nakładane na apteki, punkty apteczne i placówki obrotu pozaaptecznego w zakresie możliwości obrotu lekami. Przedmiotem pracy jest głównie ustawa Prawo farmaceutyczne.

The aim of this thesis is to present legal instruments related to regulation business activity concerning medicinal products. The thesis consists of four chapters. The first chapter concerns the concept of medicinal product. It includes the problematic aspect of borderline products. The second chapter provides reasons of regulation. The third chapter concerns the procedures of authorization of medicinal products, including such legal instruments as for example import in case of a patient’s life-threatening or health-threatening. The last one is related to mechanism of medicinal products Distribution, where the role of retail is emphasized. There are included the requirements for pharmacies, pharmacy outlets and non-pharmacy retail outlets determined by medicinal product. The subject of this thesis is mainly the Pharmaceutical Law.
