Principles governing the right to compensation for infringements of competition rules

Niniejsza praca porusza aktualny problem określenia zasad dochodzenia roszczeń odszkodowawczych z tytułu naruszenia reguł konkurencji. Wszystkie państwa członkowskie są obecnie zobowiązane do implementowania do krajowych porządków prawnych Dyrektywy Parlamentu Europejskiego i Rady 2014/104/UE z dnia 26 listopada 2014 roku, która stanowi zwieńczenie prac legislacyjnych prowadzonych przez organy unijne oraz podsumowuje dotychczasowy dorobek orzeczniczy Trybunału Sprawiedliwości Unii Europejskiej w tym zakresie. W pierwszej kolejności zostały omówione ogólne zagadnienia związane z egzekwowaniem reguł konkurencji na drodze prywatnoprawnej. Następnie została przeprowadzona szczegółowa analiza poszczególnych rozwiązań przewidzianych w dyrektywie. W ostatniej części pracy została omówiona kwestia implementacji postanowień dyrektywy do polskiego porządku prawnego.

This thesis addresses a crucial issue of the determination of principles governing the right to compensation for infringements of competition rules. Currently all Member States are obliged to implement the Directive 2014/104/EU of the European Parliament and of the Council of 26 November 2014 into their national legal systems. This Directive constitutes a completion of legislative works of European Union bodies and summarises the existing case law of the Court of Justice of the European Union in this area. Firstly, there are discussed general issues concerning private enforcement of competition rules. In the next part of the work there is carried out a detailed analysis of solutions provided in the Directive. In the end there is analysed the issue regarding the implementation of the provisions of the Directive into the Polish legal system.
