The limits of film adaptations

W niniejszej pracy magisterskiej podjęta zostaje próba określenia zakresu dopuszczalnych zmian wprowadzanych w filmowych adaptacjach dzieł literackich. Kwestia ta stanowi powszechny problem, który nie został jednak unormowany w sposób wystarczający na gruncie obowiązującego prawa autorskiego. Zawarta analiza ma na celu stworzenie precyzyjnych kryteriów, które uwzględniają zarówno interesy autora macierzystego, interes zbiorowy społeczności, jak i swobodę twórczą adaptatora. Rozpoczyna się ona od omówienia prawa do integralności, jako kluczowego dla określenia osobistych uprawnień autora, co do tego w jakiej formie ma być przedstawiane jego dzieło. Następnie przedstawione zostały estetyczne koncepcje budowy dzieł literackich, a w końcu typologia możliwych zmian i granice swobody adaptacyjnej na podstawie stosunków umownych między twórcą macierzystym, a zależnym, jak i w oparciu o ustawowe ramy.

In this master's thesis is made an attempt to determine the scope of permissible modifications in the film adaptations of literary works. This issue is a common problem, which was not standardized sufficiently under current copyright law. The aim of this analysis is to establish precise criteria, which take into account both the interests of the original author, the collective interests of the community as well as the creative freedom of adaptation's author. It begins with a discussion about the integrity right, which is as a crucial thing to determine the personal rights of the author in what form his work should be presented. Then were presented the aesthetic concepts of the construction of literary works and finally typology of possible changes and limits of freedom of adaptations based on the contractual relationship between the original author and adaptation's author as well as on the basis of the statutory framework .
