The crime of genocide as an example of Rwanda

Pojęcie zbrodni ludobójstwa w prawie międzynarodowym zdefiniowane zostało w Konwencji z 1948 roku w sprawie zapobiegania i karania ludobójstwa. Wraz z upływem czasu termin ten ewoluował, przyczyniając się do rozwoju standardów dla ochrony praw człowieka. Szacuje się, że w ludobójstwie dokonanym na ludności Tutsi w Rwandzie w 1994 roku śmierć poniosło około 800 tysięcy osób. Praca dyplomowa ma na celu przedstawienie i analizę zbrodni ludobójstwa, przyczyn, które doprowadziły do tragedii oraz analizę działalności Międzynarodowego Trybunału Karnego dla Rwandy. Trybunał powołany został w celu osądzenia winnych zbrodni ludobójstwa. W rozdziale pierwszym przedstawiono ewolucję norm prawa międzynarodowego dotyczącego zbrodni ludobójstwa. W rozdziale drugim ukazano wzajemne stosunki Hutu i Tutsi na przestrzeni lat, podkreślając przy tym wpływ władz kolonialnych. Rozdział trzeci odnosi się do wydarzeń wojny domowej w latach 1990-1993, zbrodni ludobójstwa oraz działań Organizacji Narodów Zjednoczonych w kwestii powstrzymania mordów na ludności Tutsi. W rozdziale czwartym dokonano analizy działalności MTKR oraz orzecznictwa w sprawach zbrodniarzy.

The term of ‘genocide’ in international law was defined in The Convention on the Prevention and Punishment of the Crime of Genocide in 1948. Over the years this term evolved, contributing to the development of the protection of human rights standards. It is estimated that 800,000 people were killed in the Rwandan Genocide in 1994. The aim of this thesis is to present and analyse the crime of genocide, the causes leading to the tragedy and the activities of the International Criminal Tribunal for Rwanda. The Tribunal was established to judge people responsible for the crime of genocide. The first chapter discusses the evolvement of the international law rules concerning the crime of genocide. In the second chapter the mutual relations of Hutu and Tutsi over the years are presented, with the emphasis on the influence of colonial government. The third chapter refers to the Rwandan Civil War of 1993-1994, the genocide and the part of United Nations in stopping the killings of Tutsis. Chapter four analyses the activities of ICTR and the case-law in the indictees trials.
