Przedmiotem pracy jest analiza prawnoporównawcza przepisów Kodeksów Postępowania Cywilnego z 1932 r. i z 1964 r. regulujących tematykę egzekucji z nieruchomości. Autor pracy podejmuje próbę zestawienia aktualnie obowiązujących przepisów z przepisami okresu dwudziestolecia międzywojennego, ze szczególnym uwzględnieniem zachodzących różnic oraz zmian w uregulowaniach prawnych dotyczących egzekucji z nieruchomości. Oprócz analizy dotyczącej egzekucji z nieruchomości sensu stricte, autor wyjaśnia podstawowe kwestie pojęciowe związane z egzekucją, jej rodzajami i przedmiotem, a także ogólne przepisy postępowania egzekucyjnego. Najważniejszym elementem pracy jest porównanie regulacji obydwu kodeksów, dotyczących przebiegu egzekucji z nieruchomości, począwszy od dokonania zajęcia przez organy egzekucyjne, poprzez działania zmierzające do zlicytowania zajętej nieruchomości, a kończąc na podziale sumy uzyskanej z egzekucji w celu zaspokojenia wierzycieli. Autor w oparciu o liczne komentarze znanych przedstawicieli doktryny prawniczej okresu międzywojennego oraz współczesnej i w oparciu o orzecznictwo Sądu Najwyższego, podejmuje próbę wyjaśnienia zasadności zmian zachodzących procedurze cywilnej na przestrzeni ponad osiemdziesięciu lat.

The subject of this thesis is the examination of provisions of the Codes of Civil Procedure of 1932 and 1964 governing the execution of real estates. Author attempts compare of the current legislation with the legislation of the interwar period, with particular emphasis on ongoing differences and changes in the legal regulations concerning the execution of real estate. In addition to the analysis of the execution of real estate in the strict sense, the author explains the basic conceptual issues associated with the execution, its types and object, as well as general rules of enforcement proceedings. The most important element of the thesis is to compare the regulation of both codes, concerning the course of the execution of real estate, ranging from the seizure made by enforcement authorities, through efforts to auction occupied real estate, and ending the division of the proceeds of the execution to satisfy creditors. Author based on many comments known representatives of the legal doctrine of the interwar period and contemporary, and based on the case law of the Supreme Court, attempts to explain the merits of changes of civil procedure for over eighty years.
