The right of preemption of agricultural real estates

Niniejsza praca dotyczy prawa pierwokupu nieruchomości rolnych w polskim systemie prawnym. Analiza tej tematyki oparta będzie o regulację ogólną prawa pierwokupu w Kodeksie cywilnym oraz odpowiednie przepisy szczególne. Następnie przeprowadzone zostaną rozważania dotyczące problematyki zbiegu pierwokupów. Ponadto praca zarysuje prawo pierowkupu jako jeden ze sposobów nadawania pierwszeństwa, dokonując analizy instrumentów prawnych do niego podobnych. W opracowaniu zawarta została dodatkowo analiza prawnoporównawcza tejże instytucji w oparciu o podobne rozwiązania wybranych państw europejskich. Powyższe rozważania zamknięto uwagami de lege ferenda.

This Master Thesis concerns the right of preemption of agricultural real estates in the Polish legal system. The analysis of this subject will be based on the generic preemption law in the Civil Code and the relevant special provisions. Furthermore, the deliberations would be conducted on the issue of the confluence of preemptions. In addition, thesis will draft preemption right as one of the ways of priority which is given in the analysis of legal instruments similar to it. Moreover, the study was concluded by further examination of similar laws in selected European countries. These considerations were closed with remarks de lege ferenda.
