Legal aspects concerning the age of sexual initiation as the problem of public health. Criminal and parental law regulations.

Tematem pracy są prawne aspekty dotyczące wieku inicjacji seksualnej jako istotnego problemu zdrowia publicznego, regulowanego między innymi przepisami prawa karnego i rodzinnego. Praca ma charakter przeglądowy, prezentuje i omawia aktualnie obowiązujące regulacje prawne. Porusza wątki dotyczące stanu wiedzy w zakresie dyscypliny zdrowia publicznego w odniesieniu do problemu wieku inicjacji seksualnej jako zagadnienia polityki zdrowotnej, promocji zdrowia i edukacji młodzieży. W opracowaniu zwrócono uwagę na wielosektorowość opisywanego problemu oraz jego instytucjonalny wymiar. Ponadto podjęto problem adekwatności i przydatności aktualnie wiążących regulacji prawnych zawartych w kodeksie karnym, prawie rodzinnym i opiekuńczym jako odpowiednich ram dla działań w sferze zdrowia publicznego ukierunkowanych na edukację seksualną zgodną z priorytetami wynikającymi z badań i literatury przedmiotu oraz uwarunkowań kulturowych, społecznych i wychowawczych. W pracy zastosowano metodę selekcji piśmiennictwa według pojęć kluczowych oraz analizy wybranych tekstów źródłowych. Badaniom poddano dokumenty statystyczne, dokumenty prawne (konstytucję, ustawy, rozporządzenia i decyzje), a także dokumenty prasowe. Wnioski z przeprowadzonej analizy dotyczą przede wszystkim regulacji prawnych w dziedzinie zdrowia seksualnego, edukacji seksualnej oraz istotnej roli zdrowia publicznego wobec wieku inicjacji seksualnej.

The thesis covers the topic of legal aspects of sexual initiation constituting very important problem of public health ruled also by criminal and parental law. It presents main regulations and state of science on the ground of public health discipline with reference to early sexual initiation. The main problems are described in the context of health policy and health promotion issues, presenting and discussing currently applicable regulations and trends including beside above mentioned also the education of youths.The study highlights the multi-sectoral approach and describes its institutional aspects, as well as the important issue of adequacy and suitability of legislation currently in force: Penal Code and Parental and Custody Law with the focus on the appropriate framework for actions in the area of public health. The topic of sexual education is presented in the context of the following spheres: research results and data, culture conditions and specific, social concerns and education of teens. The work is based on adequate list of literature sources relevant to the topic with the use of appropriate selection of key words. The study also bases on the subjective statistical data, legal documents with Polish constitution at the top and other legislation, including the executive regulations and decisions. Regarding the topic the press articles were also very useful source of information, presenting different attitudes towards the problem.Conclusions of the conducted analysis relate primarily to legal regulations in the field of sexual health and sexual education with a reference to a crucial role of public health in the sphere of the sexual initiation age.
