Application of Article. 17 of the European Convention on Human Rights in the context of hate speech and delegalization of radical organisations

Pierwszy rozdział pracy magisterskiej zawiera uwagi wprowadzające do tematu, zarówno historyczno-polityczne tło genezy art. 17 Europejskiej Konwencji Praw Człowieka, jak i informacje na temat struktury przepisu, jego interpretacji i możliwych dróg stosowania w orzecznictwie, a także krótkie omówienie komplementarnej z nim regulacji art. 18. Rozdział drugi zajmuje się tematyką wzajemnych relacji art. 10 i 17 oraz problematyką ich zastosowania w aspekcie nadużycia wolności wypowiedzi, czyli w szeroko pojętym kontekście zjawiska tzw. mowy nienawiści. Rozdział trzeci przedstawia ewolucję praktyki instytucji strasburskich wobec zakazu i delegalizacji organizacji skrajnych oraz zawiera ocenę kierunku tych zmian.

The first chapter of the thesis contains the introductory remarks to the topic, both historical and political background to the origins of art. 17 of the European Convention on Human Rights, as well as information on the structure of the provision, its interpretation and possible ways of application to the case law, as well as a brief summary of the complementary provisions of art. 18 The second chapter deals with the subject of the relationship art. 10 and 17, and the problems of their application in the context of abuse of freedom of expression, that is, in the wider context of the so-called phenomenon of hate speech. The third chapter presents the evolution of the practice of the Strasbourg institutions concerning the ban and outlawing of radical organizations and assesses the direction of these changes.
