Awareness of labor law as a component of the legal awareness of students. Sociological case study example of students Jagiellonian University in Krakow.

Rozważania w niniejszej pracy skoncentrowane są na przedstawieniu świadomości prawnej w odniesieniu do świadomości społecznej. Szczególna uwaga została zwrócona na to, jak funkcjonuje prawo pracy i prawo cywile, oraz jakie pełnią one zadania w stosunku do pracownika. Jedną z podstawowych kwestii jest przedstawienie poszczególnych instytucji wpierających pracownika w sytuacji łamania bądź naruszenia jego praw. Nadrzędnym celem pracy jest analiza świadomości prawnej studentów w dziedzinie zatrudnienia, a w szczególności zawieranych przez nich umów.Niniejsza praca składa się z pięciu rozdziałów. Począwszy od świadomości prawnej, po instytucje prawne, zostały w niej zawarte rozważania na temat świadomości prawnej i funkcjonowanie jednostki w systemie prawa pracy. W pierwszym rozdziale dzięki koncepcji Piotra Sztompki, przedstawione zostało pojęcie świadomości społecznej. Następnie omówione zostały poszczególne aspekty świadomości prawnej, w odwołaniu do teorii Marii Boruckiej-Arctowej. Ponadto w tym rozdziale zostały poruszone kwestie związane z prawem pozytywnym i intuicyjnym w odwołaniu do Leona Petrażyckiego. Dla pełniejszego zrozumienia sytuacji studentów została przedstawiona także wizja poczucia sprawstwa, skonstruowana przez Margaret Archer. Ma ona na celu zrozumienie umiejscowienia tej grupy w pewnej strukturze i braku wpływu na nią.Rozdział drugi zwraca szczególną uwagę, na przedstawienie prawa pracy w odniesieniu do sytuacji studentów. Zostały w nim uwzględnione takie pojęcia jak: prawo pracy, przedmiot i podmiot prawa pracy, stosunek pracy oraz stosunek prawnocywilny. Ukazuje on także wszelkie prawa i obowiązki osób zatrudnionych w oparciu o: umowę o pracę, o dzieło i zlecenie. Na koniec zostały omówione poszczególne funkcje prawa pracy, jako podsumowanie prawa pracy, które regulatorem pracy człowieka.Rozdział trzeci z uwagi na temat pracy charakteryzuje instytucje prawne, które mają na celu pomóc jednostkom w sytuacji złamania bądź też naruszenia ich praw. W tym ostatnim rozdziale teoretycznym zostały wymienione wszelkie organizacje i instytucje, które mają na celu sprzyjać równowadze stron, w momencie łamania praw pracownika. Czwarty rozdział zawiera empiryczną analizę hipotez i pytań badawczych, które zostały postawione w celu poznania i ocenienia prawnej świadomości studentów.W ostatnim rozdziale w oparciu o przeprowadzone badania empiryczne, weryfikacji zostały poddane poszczególne hipotezy i pytania badawcze.

The considerations in this paper represent the legal awareness with regard to public awareness. Particular attention has been paid to it, how it works and labor law, civilians, and they perform tasks in relation to the employee. One of the main issues is the characteristics of the various institutions that help employees in case of violation or infringement of his rights.Analysis of the legal awareness of students in the field of employment, and in particular their contracts is the main objective of this workThis paper consists of five chapters. Starting from the legal awareness, and legal institutions were included in the considerations of legal awareness and functioning of the individual in the system of labor law. In the first chapter through the concept of Peter Sztompka, was presented the concept of social consciousness. Then described the various aspects of legal awareness, in reference to the theory of Maria Borucka-Arctowa. Also in this chapter were discussed issues related to positive law and intuitive in reference to Leon Petrażycki. For a fuller understanding of the students situation was presented as the vision of a sense of agency, constructed by Margaret Archer. The second chapter draws particular attention to the representation of labor law in relation to the situation of students. Been included in it such concepts as labor law, the subject and object of labor law, employment and relationship status. This chapter describes all the rights and obligations of persons employed on the basis of: a contract of employment for work and order.The third chapter contains characterization legal institutions, which are designed to help individuals in a situation of violation of their labor rights. In this last chapter of the theoretical were listed all the organizations and institutions that are conducive to balance the parties, at the time of violations of the rights of the employee.The fourth chapter provides an empirical analysis of hypotheses and research questions. They have been placed in order to know and evaluate the legal consciousness of students.In the last chapter, based on empirical studies, verification have been subjected to various hypotheses and research questions.
