Praca magisterska pod tytułem „Szanse i zagrożenia stosowania ADR (na przykładzie mediacji, arbitrażu i negocjacji)” dotyczy metod alternatywnego rozstrzygania sporów oraz perspektyw ich rozwoju w Polsce. W pierwszym rzędzie praca wyjaśnia, czym są konflikt i spór oraz wskazuje na rodzaje sporów oraz źródła ich powstawania. Opisuje również czym są mediacje, arbitraż i negocjacje, ze wskazaniem najważniejszych zasad nimi rządzących. W pracy zostały przeanalizowane w pierwszej kolejności niektóre wady i zagrożenia zastosowania ADR, tj. niewiążący charakter rozstrzygnięć, niechęć stron sporu do wyrzeczeń, niski poziom kompetencji mediatorów oraz psychiczne nastawienie do sprawy osób uczestniczących w rozstrzyganiu sporu. Dla zachowania obiektywności w pracy opisano również część zalet stosowania pozasądowych metod rozstrzygania sporów, czyli niższe koszty i większa szybkość postępowania w porównaniu do postępowania sądowego, możliwość znalezienia rozwiązania, które usatysfakcjonuje obie strony, znalezienie faktycznego źródła konfliktu i odciążenie wymiaru sprawiedliwości. W końcowej części pracy znajdują się wnioski z wyważenia wad oraz zalet ADR, analiza perspektyw dla ich rozwoju oraz postulaty konieczne do zrealizowania w edukacji środowisk prawniczych w zakresie metod alternatywnego rozstrzygania sporów.

The master thesis titled „Opportunities and threats of the application of ADR (the examples of mediation, arbitration and negotiation)”, discusses alternative dispute resolution methods and the perspectives of their evolution in Poland. It briefly describes the concepts of conflict and dispute, differentiates the kinds of disputes and indicates their origins. It also explains what are mediation, arbitration and negotiation, and discusses their basic rules. Next, the threats and weaknesses of the ADR are analysed by taking into account the fact of non-binding outcomes, the unwillingness of the parties to renounce some of their interests, the lack of the competence of mediators and the parties’psychical approach to the dispute. In order to make the thesis impartial and objective, some strengths and opportunities of the ADR are described as well. In particular these are: the lower costs and the increase of speed in comparison to judicial proceedings, the opportunity to find a solution that better fits the parties, the discovering of the real sources of a conflict and removing some cases from the courts of justice. The summary of the thesis draws some conclusions on the basis of balancing strengths and weaknesses, opportunities and threats of applying ADR in practice. It also analyses the perspectives for the evolution of the alternative dispute resolution methods in Poland. Finally, it shows the authors’own views on the demands of lawyers education in respect to the ADR methods.
