Direct democracy in the territory of certain countries of Central and Eastern Europe

StreszczenieW niniejszej pracy poruszono kwestie dotyczące demokracji bezpośredniej na terytorium wybranych państw Europy Środkowo-Wschodniej. Zwrócono uwagę na treściowe znaczenie demokracji bezpośredniej, jej cechy, cele i formy oraz jej stanowisko w stosunku do demokracji przedstawicielskiej. Do form demokracji bezpośredniej zalicza się: referendum, obywatelską inicjatywę ludową, weto ludowe, zgromadzenie ludowe, konsultacji społeczne, recall oraz appelation of sentence. Praca ta omawia stanowiska wybitnych przedstawicieli nauki prawa konstytucyjnego na terenach Rzeczypospolitej Polski, Ukrainy oraz Rosji. Dla tego zwrócono uwagę na instytucje demokracji bezpośredniej poprzez szczegółową charakterystykę ich materii oraz prawnego zakresu z wizji róźnych szkół prawa konstytucyjnego na terytorium państw Europy Środkowo-Wschodniej. Dla analizy demokracji bezpośredniej wybrano takie państwa jak: Czechy, Słowacja, Rumunia, Polska, Litwa, Węgry oraz Ukrainy ze względu na róźnorodność reprezentacji instytucji form demokracji bezpośredniej na poziomie Ustaw Zasadniczych oraz ich zastosowanie w praktyce.Praca ta posiada wielkie znaczenie praktyczne ze względu na to, iż zawiera przykłady regulacji prawnych instytucji demokracji bezpośredniej na poziomie Konstytucji wybranych państw Europy Środkowo-Wschodniej. Umożliwia zatem ich porównawczą charakterystykę, która daje możliwość dalszego udoskonalania owych Konstytucji w zakresie demokracji bezpośredniej jako formy demokracji z uwzględnieniem najlepszych jej właściwości.

SummaryThis paper contains the concept of direct democracy in the territory of certain countries of Central and Eastern Europe. Attention is paid to the importance of the content of direct democracy, its main features, purposes and forms, and its position in relation to representative democracy. According to the paper, the well known forms of the constitutional doctrine of direct democracy are: the referendum, civic initiative folk, folk veto, popular assembly, public consultation, recall and appellation of sentence.This paper represents the position of the famous academics of constitutional law schools of such countries as Polish Republic, Ukraine and Russia. As a result, it’s describes the institutions of direct democracy through a detailed description of the legal matter and the scope of the vision of the different schools of constitutional law in the territory of the countries of Central and Eastern Europe.The Czech Republic, Slovakia, Romania, Poland, Lithuania, Hungary and Ukraine were selected for the detailed analysis of direct democracy because of the verity of forms of the institutions of direct democracy fixed at the Constitutional level and their application in practice in their territory.This paper promotes further researches on the area of the direct democracy taking into account the comparative characteristics of the provisions of Constitutions of certain countries of Central and Eastern Europe and its practice including the best of its properties.
