The appeal in tax procedure

Przedmiotem pracy magisterskiej jest analiza odwołania w polskim postępowaniu podatkowym. Praca składa się z czterech rozdziałów. W pierwszym scharakteryzowano cechy odwołania, zasadę dwuinstancyjności oraz zaprezentowano poszczególne organy odwoławcze. W drugim rozdziale opisano wymogi formalne odwołania, przedstawiono instytucję rozprawy, a także poszczególne etapy podatkowego postępowania odwoławczego. W kolejnym rozdziale scharakteryzowano rodzaje decyzji, jakie może wydać organ odwoławczy. Czwarty rozdział przedstawia instytucję zakazu reformationis in peius w podatkowym postępowaniu odwoławczym.

The subject of this Master's thesis is an analysis of the appeal in Polish tax procedure. The thesis consist of four chapters. In the first chapter the features of the appeal, authorities are presented. The second chapter describes the formal requirements of the appeal and present the institution of trial as well individual stages of the appeal tax proceeeding. In the third chapter individual types of decisions which appeal authorities can make are characterized. The fourth chapter presents the institution of reformationis in peius prohibition in appeal proceeding.
