Jednym z bieżących problemów międzynarodowego prawa i systemu praw człowieka jest prawo do samostanowienia. Ostatnie lata pokazują jak trudno jest porównywać „prawo w książkach” z „prawem w działaniu”. Prawo narodów do samostanowienia jest kontrowersyjne z powodu skutków jakie wywołuje na arenie międzynarodowej. Większość istniejących państw nie jest zainteresowana w powstawaniu nowych. Powierzchnia naszej ziemi jest już podzielona i nikt nie chce rezygnować ze swojego terytorium.Prawo do samostanowienia nie ma zdefiniowanej pozycji w systemie praw człowieka. Doktryna jest podzielona. Dogmatycy i naukowcy prawa spierają się czy podmiotem tego prawa jest jednostka czy naród jako całość. Podział na trzy generacje praw człowieka nie jest adekwatny do obecnej rzeczywistości.Oprócz doktrynalnych problemów, większym wyzwaniem jest realizacja prawa narodów do niepodległości. Autorka skupia się na wybranych przykładach Kurdystanu, Kosowa, Abchazji i Osetii Południowej. Autorka starała się zebrać informacje nie tylko z literatury przedmiotu, ale też od instytucji państwowych i ludności zamieszkującej wyżej wymienione miejsca. Dzięki Funduszowi im. Jana Kochanowskiego Uniwersytetu Jagiellońskiego autorka odbyła wizyty studyjne. Temat ten jest zbyt skomplikowany, aby móc całkowicie zgłębić go w tej pracy, zasługuje on na dalszą analizę.

One of the most current problems in the international law and human rights is the right to self - determination. Recent years proof how hard it is to compare "law in books" with "law in action". The right of nations to self - government is controversial because of consequences its results on the international scene. Most of existing countries are not interested in the forming of new ones. The surface of our planet is already divided and none would like to resign its territory.The right to self - determination does not have defined position in the system of human rights. The doctrine is disputed. Dogmatists and scientists of law are arguing whether the subject of this right is an individual or a nation as a whole. The categorization of human rights into three generations is not suitable for the contemporary world.Apart from doctrinal problems, the greater issue is with the realization of this right to independence. The author focused on the Kurdistan, Kosovo, Abkhazia and South Ossetia case studies. The author attempted to collect information from both secondary and primary sources - literature of the subject and governmental institutions and inhabitants of the mentioned places. Thanks to the Jagiellonian University’s Jan Kochanowski Found the author was enable to travelled to the above - mentioned places. This topic is too complicated and extensive to be fully covered in this paper and deserves a further analysis.
