The exclusive competences of the EU based on art. 3 TFEU

Jedną ze zmian wprowadzonych na mocy Traktatu z Lizbony jest wydzielenie katalogu kompetencji wyłącznych, dzielonych oraz mających na celu wspieranie, koordynowanie i uzupełnianie działań Państw Członkowskich. Niniejsza praca obejmuje omówienie i analizę dziedzin objętych kompetencją wyłączną Unii Europejskiej na podstawie art. 3 Traktatu o Funkcjonowaniu Unii Europejskiej do których zalicza się unię celną; wspólną politykę handlową; politykę pieniężną w stosunku do krajów, których walutą jest euro; ustanawianie reguł konkurencji niezbędnych do funkcjonowania rynku wewnętrznego oraz zachowanie morskich zasobów biologicznych w ramach wspólnej polityki rybołówstwa. W pracy została także ujęta analiza kompetencji wyłącznych do zawierania umów międzynarodowych, jeśli zostanie spełniony jeden z trzech warunków wskazanych w art. 3 ust. 2 TFUE.

The Lisbon Treaty that came into force on December 2009 introduces many changes in the EU law. One of them is clarification categories of the EU’s competence: the EU may have exclusive competence, shared competence, or competence only to take supporting, coordinating, or supplementary action. This thesis encompasses overview and analysis of the areas of exclusive competence based on art. 3 Treaty of Functioning of the European Union: customs union; common commercial policy; the establishing of the competition rules necessary for the functioning of the internal market; monetary policy for the Member States whose currency is the euro; the conservation of marine biological resources under the common fisheries policy, and also exclusive competence for the conclusion of an international agreement when its conclusion is provided for in a legislative act of the Union or is necessary to enable the Union to exercise its internal competence, or in so far as its conclusion may affect common rules or alter their scope.
