The perspectives of the ILC Articles on the protection of persons in case of disasters

W artykule omówiono ostateczną wersję Artykułów Komisji Prawa Międzynarodowego o ochronie osób w przypadku katastrof, przyjętą przez KPM w 2016 r. Odniesiono się do genezy i założeń aksjologicznych tego projektu kodyfikacyjnego, wyjaśniono jego treść i perspektywy stosowania w praktyce państw. Istotne miejsce w rozważaniach autora zajmuje pojęcie "katastrofy" oraz katalog zobowiązań państw dotkniętych katastrofą lub wyrażających wolę niesienia pomocy humanitarnej. Rozważania dotyczą także rekomendacji KPM, aby Artykuły stały się podstawą wynegocjowania przez państwa nowego traktatu dotyczącego ochrony osób w przypadku katastrof. Autor dochodzi do wniosku, że stanowiska państw zaprezentowane na posiedzeniach VI Komitetu Zgromadzenia Ogólnego ONZ nie pozwalają na optymizm co do potencjalnego zwołania konferencji międzynarodowej w celu opracowania projektu takiego traktatu. Mimo to inicjatywa opracowania instrumentu prawnie wiążącego zyskała pewnych sprzymierzeńców, stąd nie można wykluczyć, że w przyszłości niektóre państwa podejmą na ten temat negocjacje.

The article discusses the final version of the International Law Commission's Articles on the protection of persons in case of disasters, adopted by the Commission in 2016. The author traces the origins and axiological underpinnings of the Articles, and proceeds to its contents and perspectives of their further application by states. With respect to the final text of the Articles, the paper explains the meaning of the term "disaster" adopted by the ILC, as well as the main obligations of states affected by a disaster or wanting to assist an affected state. Further, the author comments on the ILC's recommendation to consider the Articles as the basis for codifying a new treaty on the protection of persons in case of disasters. A conclusion is offered that the exchanges of views in the Sixth Committee of the General Assembly of the United Nations so far do not allow for much optimism as to a possible launch of an international conference to draft such a treaty.
