Hosting as the Information Society Service in Relation to Copyright Infringement on the Internet

Niniejsza praca magisterska poświęcona jest tematyce hostingu jako usługi społeczeństwa informacyjnego. W rozprawie opisano problem naruszeń praw autorskich związanych z jej wykorzystywaniem. Omówione zostały poszczególne przepisy amerykańskiej ustawy Digital Millenium Copyright Act, postanowienia tzw. dyrektywy o handlu elektronicznym, a także implementujące ją akty prawne państw członkowskich Unii Europejskiej, w tym polska ustawa o świadczeniu usług drogą elektroniczną. Wskazano na trudności interpretacyjne dotyczące pojęć zawartych zarówno w unijnym, jak i polskim akcie prawnym, które powodują liczne problemy ze stosowaniem prawa w praktyce. Opisane zostały przesłanki dla wyłączenia odpowiedzialności hostingodawców za dokonane naruszenia prawa autorskiego oraz zasady jej ponoszenia. Zaznaczono kierunki rozwoju prawodawstwa dotyczącego hostingu oraz innych usług świadczonych przez dostawców internetowych. W pracy przedstawione zostały także kontrowersje towarzyszące planowanym przez Komisję Europejską zmianom, w tym propozycji nowej dyrektywy; zwrócono też uwagę na konieczność nowelizacji przepisów w celu zapewnienia skutecznej ochrony podmiotom prawa autorskiego, jak również prawidłowego funkcjonowania Internetu.

The present dissertation concerns hosting as the information society service in relation to the copyright infringement on the Internet that may result from using this service. This paper describes particular provisions of the US Digital Millennium Copyright Act, the so called E-commerce Directive as well as regulations of EU member countries that implement its laws, and especially the Polish Act on Rendering Electronic Services. The dissertation also mentions the interpretation difficulties of the terms used in the above regulations which cause problems in everyday practice. One has also described the necessary conditions pertaining to limitations of liability of hosting providers in copyright infringement as well as the rules of one’s liability. Possible directions of hosting law development and other provided services are also indicated. Finally, this dissertation covers the controversies caused by the European Commission’s new directive proposal and the necessity of implementing changes in order to both provide effective protection to the copyright owners and also to ensure the normal functioning of the Internet.
