The attitudes of footbal hooligans in Poland. Criminological and Penal Law aspects.

Niniejsze opracowanie poświęcone zostało zachowaniom pseudokibiców piłkarskich, specyficznej grupie społecznej, której aktywność przejawia się w wielu płaszczyznach życia społecznego. Ujęto w nim zarówno przejawy tzw. „chuligaństwa stadionowego”, jak i problematykę zachowań dewiacyjnych grup związanych ze środowiskiem kibiców, ale popełniających przestępstwa poza stadionami. W pracy tej zawarto zarówno próbę uporządkowania definicji związanych z chuligaństwem futbolowym, historyczne początki problemu „chuligaństwa stadionowego”, który nie jest fenomenem współczesności, jak i charakterystykę publiczności, w tym kibiców oraz pseudokibiców. Omówiono także niektóre przejawy działalności pseudokibiców, którzy organizują się w struktury zbliżone do grup przestępczych z przywódcami na czele. Szczególna uwaga autorki skupiła się na podkreśleniu zjawiska przesunięcia „chuligaństwa stadionowego” ograniczonego terytorialnie i czasowo do terminarza rozgrywek piłkarskich w stronę „pozastadionowej” działalności pseudokibiców (ustawki, wjazdy), której związek z piłką nożną jest coraz słabszy i tworzy nową, ciekawą tematykę kryminologiczną. Na kartach niniejszego opracowania ujęto także próbę ustalenia przyczyn przejawiania przez pseudokibiców zachowań dewiacyjnych, charakteryzujących się agresją i stosowaniem nieuzasadnionej przemocy. Ostatnia część pracy stanowi omówienie skutecznych, według autorki metod przeciwdziałania opisanemu zjawisku patologicznych zachowań pseudokibiców piłkarskich. Celem niniejszego opracowania jest przedstawienie w usystematyzowany sposób najistotniejszych zagadnień związanych z pseudokibicami, takich jak zdefiniowanie poszczególnych grup pseudokibiców, scharakteryzowanie ich działalności, wskazanie zagrożeń płynących z niektórych przejawów ich aktywności, przyczyn funkcjonowania takich grup w społeczeństwie oraz próba znalezienia sposobu rozwiązania tego problemu.

The thesis presented is fully devoted to the attitudes and behaviours of football hooligans, including the phenomenon of committing the offenses. In order to present the issue in a holistic matter, beginning from basic concepts – e.g. sports events, a football fan and a football hooligan, the following thesis also describes the genesis of criminality among hooligans, and the most effective modes of action against this particular criminality. The above mentioned ordination was introduced in order to simplify an evolving, complex and difficult to study or characterize phenomenon.The term attitudes in the title was used in order to focus the reader’s attention on several aspects of hooligans’ destructive acts – not only those subjected to penal law, but also other pathological behaviours which are against the social norms but not forbidden by the law. To present the issue comprehensively, both – stadium hooliganism and other offences committed by the hooligans beyond the stadiums are analyzed.To understand this particular phenomenon, the origins of it must be precisely defined and researched. The first chapter provides a definition for a sports event, and an outline of a sports events’ history in ancient Greece, Rome, in medieval Europe; it describes the era of football, with relation to first signs of aggression and other types of deviant behaviour among the spectators. Moreover, in the chapter, the attempt of ordering the terms audience, spectator and football fan was made; giving a starting point for providing a contemporary fan’s characteristics.Afterwards, the stadium spectators were analyzed, with the typologies presented in literature, by the police experts, and created by the author of this thesis. Every separated group was characterized, and the one, which members due to their attitudes were committing the offences the most often, was indicated.The typology presented in chapter two, due to the deviant behaviours of its members, separated the group called football hooligans. The precise characteristics of the group was provided in chapter three, together with description of selected deviant behavior examples, the penal law aspects of the acts, and the hooligans’ modes of action – which include the use of pyrotechnics during the matches, the use of passwords and symbols inciting intolerance, fascist and racist views. Several forms of fight were also mentioned – within the hooligans, but also against the police, arising out of undisguised hatred of the above mentioned institution.The fourth chapter is an attempt of determination the causes of the hooligans’ deviant acts, characterized by the use of aggression and violence. The theory of collective behavior, biological sources of the aggression, the concept frustration-aggression, the theory of social violence learning and the concept of subculture of violence, as possible causes, were raised. Also, the media’s influence was examined in the above mentioned chapter.The last part of the thesis is a discussion on the effective, according to the author, methods of counteracting the pathological behaviours of the football hooligans. Both – Polish and international legislative solutions and social programs aimed at educating the youths and preventing them from entering a dangerous hooligans group, were cited.A distinctive slang, which cannot be always understood easily by someone from the outside, is often used among the groups of hooligans, therefore particular phrases were in this thesis quoted and explained.The aim of this thesis is to present, in a systematic manner, the most important issues concerning the attitudes of the football hooligans, to characterize their actions, to present the causes of formation of such groups, and the possible solutions for the problem of hooliganism.
