Euthanasia and assisted suicide in the case law of the European Court of Human Rights

Praca porusza problematykę tematu eutanazji i wspomaganego samobójstwa w ujęciu orzecznictwa Europejskiego Trybunały Praw Człowieka. Rozdział I przedstawia szeroki kontekst zagadnienia zakańczania życia. W oparciu o rys historyczny przedstawiono, jak na przestrzeni wieków zmieniało się podejście prawne, społeczne i filozoficzne do tematu eutanazji i wspomaganego samobójstwa, od starożytności przez czasy nowożytne aż do końca okresu II Wojny Światowej. Przedstawiono również rozważania na temat definiowania pojęcia „eutanazji” i „wspomaganego samobójstwa” w czasach współczesnych. Drugi rozdział zawiera analizę najważniejszych z punku widzenia eutanazji i wspomaganego samobójstwa wyroków Europejskiego Trybunału Praw Człowieka. Aby lepiej zrozumieć motywacje skarżących szczegółowo opisano stan faktyczny, który zestawiono z argumentami Trybunału podniesionymi w uzasadnieniach przytoczonych wyroków. Na koniec wskazano główne problemy, z którymi mierzył się Trybunał badając wniesione skargi – należą do nich kwesta „prawa do śmierci, „jakości życia”, pojęcie „uporczywej terapii”, kwestia woli pacjenta przy stosowaniu procedur medycznych oraz problem wspomaganego samobójstwa.

The work deals with the topic of euthanasia and assisted suicide in the light of the case law of the European Court of Human Rights. Chapter I presents the broad context of the termination of life. Based on the historical outline, how the legal, social and philosophical approach has changed over the centuries to the subject of euthanasia and assisted suicide, from antiquity to modern times until the end of the World War II. There are also deliberations on defining the concept of "euthanasia" and "assisted suicide" in modern times. The second chapter contains an analysis of the most important from the point of view of euthanasia and assisted suicide of the judgments of the European Court of Human Rights. In order to better understand the applicants' motivations, the facts were described in detail, which were compared with the Court's arguments raised in the justifications of the judgments cited. Finally, the main problems faced by the Court in examining the complaints - the issue of "the right to death," quality of life, the concept of "persistent therapy", the question of the will of the patient in the application of medical procedures and the problem of assisted suicide - are indicated.
