Amicable resolution of disputes on the financial market

Celem pracy jest próba wykazania, iż polubowne sposoby rozwiązywania sporów mają zastosowanie na rynku finansowym, a szczególnie, jak sprawdzają się: mediacja, arbitraż oraz koncyliacja. Na rynku finansowym można wyróżnić, m.in następujące polubowne sposoby rozstrzygania sporów: mediację, arbitraż oraz koncyliację. Mediacja umożliwia zwaśnionym stronom przedstawienie swoich poglądów podczas rozmowy, której przewodniczy osoba bezstronna – mediator. Strony mają też możliwość skorzystania z arbitrażowego sposobu rozwiązywania sporów na rynku finansowym. Mogą one liczyć na bezstronny przebieg czynności oraz sprawiedliwy wyrok arbitra. Kolejnym polubownym sposobem rozwiązywania sporów na rynku finansowym jest koncyliacja. Koncyliator występuje tu ze sprecyzowaną propozycją rozwiązania istniejącego sporu, a akceptacja takiego rozwiązania jest uprawnieniem stron. Istnieje też możliwość złożenia wniosku do Rzecznika Finansowego o przeprowadzenie postępowania polubownego. Polubowne formy rozwiązywania sporów na rynku finansowym występują także w innych krajach, m. in.: w Stanach Zjednoczonych, Wielkiej Brytanii, Francji, Niemczech oraz Włoszech. Obecnie w Polsce coraz częściej stosuje się polubowne rozwiązywanie sporów na rynku finansowym ze względu na elastyczność zasad i swobodę stron w zakresie kształtowania procedury postępowania.

The aim of the thesis is an attempt to show that the amicable methods of resolving disputes are applicable on the financial market and, in particular how the mediation, arbitration and conciliation work. On the financial market, we can distinguish the following amicable methods of resolving disputes: mediation, arbitration and conciliation. Mediation allows the conflicted parties to present their points of view during a conversation chaired by an impartial person called mediator. The parties also have an option to use the arbitration method of resolving disputes on the financial market. They can rely on the impartial conduct of the proceedings and a fair judgment of the arbitrator. Another amicable way of resolving disputes on the financial market is conciliation. The conciliator makes a specific proposal to resolve the existing dispute and the acceptance of such solution is the right of the parties. It is also possible to submit an application to the Financial Ombudsman for conducting an amicable proceeding. Amicable forms of resolving disputes on the financial market are also present in other countries, including the United States, Great Britain, France, Germany and Italy. Currently in Poland amicable resolution of disputes on the financial market is increasingly being used due to the flexibility of the rules and the freedom of the parties in shaping the procedures.
