Disciplinary proceedings in The Polish Scouting and Guiding Association in comparison with criminal law

Praca traktuje o postępowaniu dyscyplinarnym w Związku Harcerstwa Polskiego, prowadzonym przez właściwych komendantów oraz sądy harcerskie, ocenionym z perspektywy przyjętego wzorca, jakim jest polskie prawo karne. Celem pracy jest ocena strony systemowej i praktycznej postępowania. To też dywagacja na temat sankcjonowania społecznego w odniesieniu do rozstrzygnięć uprawnionych do tego w organizacji organów, a także ewentualna bezprawność ich publikacji. Praca mówi także o ewentualnych możliwościach kontroli spraw wewnątrzorganizacyjnych przez państwo, w tym przez sądy - zarówno na wniosek zainteresowanego członka ZHP, jak i właściwych organów nadzoru.Rozważania opisane wyżej powstały w związku z pojawiającymi się w Związku Harcerstwa Polskiego postulatami odnośnie zmian systemowych w karaniu instruktorów ZHP. Owe postulaty mają swoje podłoże w subiektywnym postrzeganiu niektórych rozstrzygnięć jako niesprawiedliwe, w szeroko rozumianym tego słowa znaczeniu. Wnioski z pracy odpowiadają na niektóre z tych zarzutów. Autor pracy, na ich podstawie, proponuje konkretne rozwiązania na zdiagnozowane problemy.

The thesis deals with disciplinary proceedings in The Polish Scouting and Guiding Association, run by competent territorial unit's chiefs and scout courts, assessed from the perspective of the adopted model, which is the Polish criminal law. The aim of the work is to assess the system and practical perspective of mentioned proceedings. It is also a diligence on the subject of social sanctioning in relation to the decisions of authorized bodies, as well as the possible illegality of publishing those decisions. This thesis also tells about possibilities of state bodies supervision, including courts - both at the request of an interested organization's member as well as a competent supervisory authorities. The considerations described above were made because of the postulates regarding systemic changes in punishing scout instructors. These postulates have their basis in the subjective perception of some decisions as unjust. Conclusions made in the thesis are the answer to some of these allegations. The author of the thesis proposes specific solutions for diagnosed problems.
