Autonomy of will and the prohibition of discrimination

Praca magisterska dotyczy konfliktu dwóch zasad mających swe źródła w wartościach podstawowych: autonomii woli i zakazu dyskryminacji. Ochrona przeciwko zachowaniom dyskryminacyjnym jest z pewnością potrzebna. Istnieją takie przejawy dyskryminacji, na które w społeczeństwie XXI wieku nie ma przyzwolenia. Niestety nieprecyzyjność pojęcia dyskryminacji oraz problemy z określeniem jego granic stwarzają realne zagrożenie dla zasady autonomii woli. Niniejsza praca jest próbą odpowiedzi na pytanie o zakres i intensywność ograniczeń zasady autonomii woli, jakie wypływają obecnie z regulacji zakazujących dyskryminacji. Praca porusza zarówno tematykę horyzontalnego oddziaływania praw podstawowych oraz wpływu przepisów antydyskryminacyjnych rangi ustawowej na stosunki prywatnoprawne.

The thesis concerns the conflict between two principles based on fundamental values: autonomy of will and prohibition of discrimination. Protection against discriminatory behaviour is certainly needed. There are some forms of discrimination that are not allowed in 21st century society. Unfortunately, the imprecision of the concept of discrimination and the problems in defining its limits pose a real threat to the principle of autonomy of will. This thesis is an attempt to answer the question of the scope and intensity of the restrictions on the principle of autonomy of will that currently arise from regulations prohibiting discrimination. The work addresses both the horizontal impact of fundamental rights and the impact of anti-discrimination laws of statutory rank on private law relations.
