The Impact of Declaring Consumer Bankruptcy on Civil Proceedings

Tematem niniejszej pracy jest problematyka wpływu ogłoszenia upadłości konsumenckiej na postępowanie cywilne. W rozdziale pierwszym przedstawiono ogólną charakterystykę polskiego modelu upadłości konsumenckiej wraz z historią wprowadzenia regulacji prawnej tej instytucji, a także porównano polskie rozwiązania z wybranymi regulacjami zagranicznymi. Rozdział drugi został poświęcony zagadnieniu wpływu ogłoszenia upadłości konsumenckiej prowadzonej na zasadach przewidzianych dla przedsiębiorców na inne postępowanie cywilne. Scharakteryzowano w nim również postępowania dotyczące masy upadłości i pozycję prawną syndyka masy upadłości, który występuje w tych postępowaniach. Przedmiotem ostatniego rozdziału jest omówienie skutków ogłoszenia upadłości konsumenckiej prowadzonej według przepisów szczególnych dla toczących się procesów cywilnych - w zależności od każdego z możliwych sposób zakończenia postępowania upadłościowego.

The subject of this thesis is the issue of the impact of the declaration of consumer bankruptcy on civil proceedings. The first chapter presents a general overview of the Polish model of consumer bankruptcy, including the history of the introduction of the legal regulation of this institution, and compares the Polish solutions with selected foreign regulations. The second chapter is devoted to the issue of the impact of the declaration of consumer bankruptcy conducted under the rules provided for entrepreneurs on other civil proceedings. It also characterizes proceedings concerning the bankruptcy estate and the legal position of the bankruptcy trustee who participates in these proceedings. The final chapter discusses the effects of the declaration of consumer bankruptcy conducted under special provisions on pending civil proceedings – depending on each possible conclusion of bankruptcy proceedings.
