Introduction of a state of emergency in Poland as exemplified by the normalization of the situation on the Polish-Belarusian border

Tematem pracy jest „Wprowadzenie stanu wyjątkowego w Polsce na przykładzie normalizacji na granicy polsko- białoruskiej”. Praca ma na celu analizę aspektów wprowadzenia stanu wyjątkowego w Polsce, koncentrując się głównie na przykładzie stanu wyjątkowego na granicy polsko-białoruskiej, który wprowadzony został 2 września 2021 r. W pracy podjęto metodę analizy dogmatycznej, opierając się na interpretacji przepisów Konstytucji RP oraz innych aktów prawnych o stanie wyjątkowym, a także analizując orzecznictwo, literaturę oraz raporty medialne. Praca została podzielona na 3 części – aby dokładnie opisać prawny aspekt stanu wyjątkowego, a także społeczną i polityczną stronę sytuacji na granicy wschodniej. W pierwszym rozdziale przedstawiono ewolucję regulacji stanu wyjątkowego oraz jego istotę, zwracając uwagę na kompetencje poszczególnych organów państwowych, procedurę wprowadzenie stanu wyjątkowego oraz jego warunki. Drugi rozdział pracy poświęcony został szczegółowej analizie sytuacji na granicy polsko- białoruskiej, której okoliczności doprowadziły do wprowadzenia stanu wyjątkowego. Opisano przyczyny jak i skutki sytuacji na wschodniej granicy, zwracając uwagę na działania Polski i Unii Europejskiej podejmowane przeciwko Białorusi. Poddano analizie skutki społeczne i polityczne, takie jak wpływ na ludność kraju i ograniczenia wprowadzone na obszarze stanu wyjątkowego. Trzeci rozdział dotyczy prawnych aspektów zakończenia stanu wyjątkowego jak i dalszego kontynuowania niektórych obostrzeń przez państwo polskie w celu ochrony granic. Opisano środki i obostrzenia wprowadzone oraz podjęto analizie w jakim stopniu stan wyjątkowy przyczynił się do osiągnięciu całkowitej stabilizacji i normalizacji sytuacji.

The subject of the work is "The introduction of a state of emergency in Poland on the example of normalization on the Polish-Belarusian border". The work aims to analyze the aspects of the introduction of a state of emergency in Poland, focusing mainly on the example of the state of emergency on the Polish-Belarusian border, which was introduced on September 2, 2021. The work uses the method of dogmatic analysis, based on the interpretation of the provisions of the Constitution of the Republic of Poland and other legal acts on the state of emergency, as well as analyzing case law, literature and media reports. The work is divided into 3 parts - to precisely describe the legal aspect of the state of emergency, as well as the social and political side of the situation on the eastern border. The first chapter presents the evolution of the regulation of the state of emergency and its essence, paying attention to the competences of individual state bodies, the procedure for introducing a state of emergency and its conditions. The second chapter of the work is devoted to a detailed analysis of the situation on the Polish-Belarusian border, the circumstances of which led to the introduction of a state of emergency. The causes and effects of the situation on the eastern border are described, paying attention to the actions of Poland and the European Union taken against Belarus. The social and political consequences were analyzed, such as the impact on the country's population and the restrictions introduced in the area of the state of emergency. The third chapter concerns the legal aspects of ending the state of emergency and the further continuation of some restrictions by the Polish state in order to protect the borders. It describes the measures and restrictions introduced and analyzes to what extent the state of emergency contributed to achieving complete stabilization and normalization of the situation.
