The Legal Situation of Ukrainian Citizens Conducting Business Activity in Poland

Praca licencjacka pt.: „Sytuacja prawna obywateli Ukrainy prowadzących działalność gospodarczą w Polsce” koncentruje się na analizie systemowych trudności, jakie napotykają cudzoziemcy w procesie rejestracji działalności gospodarczej. Celem pracy jest wskazanie, w jakim stopniu obowiązujące przepisy w szczególności specustawa z 2022 r. oraz wcześniejsze uwarunkowania wynikające z układu stowarzyszeniowego UE–Ukraina, wpływają na możliwości integracji gospodarczej obywateli Ukrainy. Przeanalizowano różne tytuły pobytowe, regulacje ustawy o cudzoziemcach oraz ustawy o zasadach uczestnictwa cudzoziemców w obrocie gospodarczym. Praca ukazuje zarówno pozytywne zmiany legislacyjne, jak i ograniczenia praktyczne, takie jak przewlekłość postępowań czy ograniczony dostęp do informacji. Główne wnioski wskazują na potrzebę dalszych reform, zapewniających spójność i trwałość regulacyjną oraz równowagę pomiędzy otwartością systemu a interesem państwa.

The bachelor’s thesis entitled “The Legal Situation of Ukrainian Citizens Conducting Business Activity in Poland” focuses on the analysis of systemic difficulties faced by foreigners during the process of registering a business. The aim of the thesis is to determine the extent to which the applicable legal regulations in particular the 2022 Special Act as well as earlier conditions resulting from the EU–Ukraine Association Agreement, influence the economic integration opportunities of Ukrainian citizens. The study examines various residence titles, the provisions of the Act on Foreigners, and the Act on the Rules of Participation of Foreign Entrepreneurs in the Economic Market. The thesis highlights both the positive legislative changes and the practical limitations, such as the lengthiness of administrative procedures or limited access to reliable information. The main conclusions point to the need for further reforms to ensure legal consistency and stability, as well as a balance between the openness of the system and the protection of national interests.
