Artykuł jest wyrazem przekonania, że nowoczesny proces karny powinien w jak najszerszym zakresie wykorzystywać najnowsze osiągnięcia o charakterze technicznym oraz informatycznym, dzięki czemu możliwa będzie w wyższym niż dotychczas stopniu realizacja tradycyjnych celów i funkcji procesu karnego. Kluczowym postulatem Autora jest konieczność, a przynajmniej użyteczność wdrożenia przepisów regulujących nagrywanie rozpraw sądowych przy wykorzystaniu urządzeń przekazujących obraz oraz dźwięk, a następnie transmitowanie (streaming) rozprawy za pomocą sieci Internet. Za punkt wyjścia dla wprowadzenia niniejszego rozwiązania z perspektywy normatywnej uznano konstytucyjną i konwencyjną zasadę publicznego procedowania, a także tej samej rangi zasadę ochrony prawa jednostki do prywatności. Zamysł ten jest nieuchronnym skutkiem rewolucji cyfrowej, która nie tylko ułatwia, ale wręcz umożliwia w szerokim zakresie, tak wpływanie na prewencję ogólną, jak i wychowawczy aspekt rozprawy sądowej. Mając na względzie niezwykle kontrowersyjny charakter propozycji legislacyjnej, w opracowaniu przedstawiono zalety i wady wskazanego rozwiązania, zapraszając czytelnika do podjęcia dyskusji i wyrażenia swojego zdania.

The article is an expression of the belief that a modern criminal process should, to the greatest extent possible, use the latest technical and IT achievements, which allow the functions and goals of criminal proceedings to be implemented even better than before. The author points out that it is justified, or at least useful, to adopt regulations regulating the recording of court hearings using devices transmitting image and sound, and then transmitting the hearing via the Internet. Taking into account the applicable regulations, it is crucial to pay attention to the constitutional and international principle of public proceedings, as well as to the principle of the same importance of protecting the individual’s right to privacy. The legislative proposal is a consequence of the digital revolution, which not only facilitates but also enables a wide range of influence on general prevention, as well as has an important educational. Aware of the extremely controversial nature of the submitted postulate, the article presents the advantages and disadvantages of introducing the broadcast of hearings, encouraging the reader to engage into the debate
