The legacy of the Wimbledon case : centenary of the first judgment of the Permanent Court of International Justice

dc.abstract.enIn its first judgment, the Permanent Court of International Justice referred to the legal issues that are important both for procedural and substantive international law, and which continue to attract the attention of States, courts and scholars. These include State sovereignty, sources of international law, interpretation of legal rights and obligations following from treaties and custom, ‘objective regimes’, ‘selfcontained regimes’, or the status of international waterways. Moreover, the 2022 armed attack by Russia against Ukraine draws particular attention to the issues considered by the pcij in this case, that is, neutrality in armed conflicts and third- party participation in international adjudication. The latter is currently illustrated by the disputes pending before the icj between Ukraine and the Russia Federation, the Gambia and Myanmar or South Africa and Israel regarding alleged violations of the Genocide Convention. The editors and other contributors to this book address the mentioned problems under the legacy of the Wimbledon decision.
