The issues of rejection of an inheritance on behalf of a child without the guardianship court permit

Artykuł omawia nową regulację, która pozwala rodzicom odrzucić spadek w imieniu spadku w imieniu dziecka bez zgody sądu opiekuńczego (nowy art. 101 § 4 Kodeksu rodzinnego i opiekuńczego). Odrzucenie spadku z pominięciem tego zezwolenia zależy od spełnienia następujących przesłanek: (1) dziecko jest powołane do spadku wskutek uprzedniego odrzucenia spadku przez jego rodzica; (2) inni zstępni tego rodzica również odrzucają spadek (3) oboje rodzice zgadzają się na odrzucenie spadku. Tekst analizuje wszystkie wszystkie te przesłanki, koncentrując się na najbardziej kontrowersyjnych kwestiach powodujących praktyczne problemy ze stosowaniem nowej regulacji.

The article discusses a new regulation which allows parents to disclaim the inheritance in the name of their child without a consent of a family court (the new Art. 101 § 4 of the Polish Family and Guardianship Code). This new possibility depends on several conditions, that is: (1) the child is appointed as an heir due to the prior disclaimer of the inheritance by his parent; (2) other descendants of that parent also disclaim the inhe- ritance; (3) both parents agree on the disclaimer. The text examines all these premises focusing on the most controversial questions troubling the notarial praxis.
