On apparent ignorance of the law (the 'ignorantia iuris nocet' principle in the Polish legal system)

Współczesna złożoność materii prawa rodzi pytania o dalszą adekwatność zasady "ignorantia iuris nocet". Rzekoma nieścisłość rodzi się między ogromem składników prawa a spodziewaną niską jego świadomością w społeczeństwie. Artykuł ma na celu wykazanie fałszu tej nieścisłości, tłumacząc adekwatność zasady "ignorantia iuris nocet" jego systemowym i konstytucyjnym zakresem, systemowym podejściem prawodawcy do jego wyważania, naturalną świadomością prawną w społeczeństwie i wreszcie zgodnością świadomości prawnej między obywatelami a sądami, która umożliwia dostateczną przewidywalność treści orzeczeń.

The contemporary complexity of the matter of law raises questions about the continued relevance of the "ignorantia iuris nocet principle". The alleged inaccuracy arises between the enormity of the law's components and the expected low awareness of it in society. The article aims to demonstrate the falsity of this incongruity by explaining the adequacy of the "ignorantia iuris nocet principle" by its systemic and constitutional scope, the legislator's systemic approach to balance it, natural legal awareness in society and, finally, the congruence of legal awareness between citizens and courts that allows sufficient predictability of the content of judgments.
