Polish Development Fund support mechanisms for entrepreneurs (a legal perspective)

Przedmiotem artykułu jest prezentacja mechanizmu wsparcia udzielanego przedsiębiorcom przez Polski Fundusz Rozwoju. W ramach tak określonego problemu badawczego wyznaczono – w formie pytań – trzy cele szczegółowe opracowania: Jakie są cele wsparcia i jakie podmioty mogą korzystać z pomocy Funduszu? Jakie są formy prawne i zasady udzielania wsparcia przez Fundusz? Jakie są źródła finansowania Funduszu? W artykule przyjęto metodę badawczą polegającą na analizie przepisów prawnych zawartych przede wszystkim w Ustawie z dnia 4 lipca 2019 r. o systemie instytucji rozwoju (tekst jednolity: Dz.U. z 2023 r. poz. 1103 z późn. zm.). Przeprowadzone rozważania potwierdziły trafność sformułowanej w artykule hipotezy, iż Polski ustawodawca wyposażył Fundusz w instrumenty prawne umożliwiające skuteczne wspieranie przedsiębiorców. Tym niemniej sformułowano pod adresem ustawodawcy pewne rekomendacje pozwalające na udoskonalenie mechanizmu wsparcia. Po pierwsze, należy postulować zmianę art. 13 ust. 1 ustawy o systemie instytucji rozwoju poprzez rozszerzenie katalogu papierów wartościowych, które mogą być nabywane przez Polski Fundusz Rozwoju celem wsparcia przedsiębiorców. Po drugie, rekomenduje się zmianę ustawy o systemie instytucji rozwoju w kierunku poszerzenia możliwości finansowania Polskiego Funduszu Rozwoju przez przekazywanie mu akcji spółek Skarbu Państwa. Po trzecie, należy jednoznacznie wprowadzić do ustawy o systemie instytucji rozwoju możliwość wystawiania przez Fundusz weksli celem finansowania realizacji rządowego programu udzielania wsparcia finansowego.

The subject of this article is a presentation of the support mechanisms provided to entrepre-neurs by the Polish Development Fund. Within such a research issue, three detailed aims have been outlined in the form of questions: What are the aims of such support and which businesses can receive help from the Fund? What are the legal forms and rules for providing support from the Fund? What are the sources of financing for the Fund? The research method applied consists in an analysis of the legal regulations contained, above all, in the Statute of 4 July 2019 on the Development Institutions System(consolidated text: Journal of Laws of 2023 item 1103 with later amendments). The discussion confirms the accuracy of the hypothesis that the Polish legislator has equipped the Fund with legal instruments enabling effective support for entrepreneurs. All the same, some recommendations are directed to the legislator to allow for an improved support mechanism. Firstly, a call for a change to article 13 item 1, the Statute on the Development Institutions System, through an extension of the catalogue of securities which can be purchased by the Polish Development Fund for supporting entrepreneurs. Secondly, the Statute the Development Institutions System should extend finance for the Polish Development Fund through transferring shares of State Treasury companies to the Fund. Thirdly, the ability to issue a bill of exchange from the Fund for the realization of a governmental program for providing financial support should be introduced to the Statute on the Development Institutions System.
