Very high capacity networks as a challenge for EU telecommunications law

Artykuł analizuje prawne wyzwania związane z wdrażaniem sieci o bardzo dużej przepustowości w Unii Europejskiej oraz wpływ regulacji na inwestycje telekomunikacyjne. Autorka wskazuje, że Unia Europejska pozostaje w tyle za światowymi liderami technologicznymi, co wymaga bardziej zrównoważonych działań regulacyjnych. W artykule omówiono różne aspekty unijnej regulacji łączności elektronicznej, takie jak współinwestowanie w infrastrukturę, regulację dostępu do sieci i zasadę neutralności sieci. Tekst podkreśla, że nadmierna regulacja może zniechęcać do inwestycji, podczas gdy bardziej deregulacyjne podejście mogłoby wspierać rozwój technologiczny. Wyzwaniem dla regulatorów pozostaje również znalezienie równowagi pomiędzy celami unijnego prawa łączności elektronicznej wymienionymi w Europejskim kodeksie łączności elektronicznej przede wszystkim między rozwijaniem sieci o bardzo dużej przepustowości a zapewnieniem dobrej jakości, publicznie dostępnych i tanich usług.

The article analyses legal challenges related to the implementation of Very High Capacity Networks (VHCN) in the European Union and the impact of regulations on telecommunications investments. The author points out that the European Union lags behind global technological leaders, which calls for more balanced regulatory actions. The article discusses various aspects of EU electronic communications regulation, such as co-investment in infrastructure, network access regulation, and the principle of net neutrality. It emphasises that overregulation can deter investments, while a more deregulatory approach could foster technological development. Regulators also face the challenge of finding a balance between the objectives of EU electronic communications law outlined in the European Electronic Communications Code, especially between the development of high capacity networks and the provision of high-quality, publicly accessible, and affordable services.
