Alibi as a forensic-procedural institution in the Polish legal system

Celem niniejszego opracowania jest zdefiniowanie instytucji alibi oraz określenie roli jaką pełni w polskim procesie karnym. Ponadto, autor koncentruje się na przedstawieniu alibi jako sposobu obrony oskarżonego (podejrzanego), a także uwzględnia metody budowania alibi w każdym stadium postępowania karnego. Również opisuje zasady i taktykę sprawdzania alibi oraz podaje przykłady metod sprawdzania alibi. Praca bazuje głównie na literaturze polskiej. Autor przytoczył poglądy przedstawicieli nauk kryminalistycznych oraz prawa karnego materialnego i procesowego. Oparł się również na orzecznictwie wypracowanym przez polskie sądy powszechne oraz Sąd Najwyższy. Co więcej, na potrzeby pracy autor przeprowadził badania akt sądowych, aby przedstawić alibi od strony praktyki stosowanej przez polskie sądy. Koniec opracowania obejmuję wnioski, ze szczególnym podkreśleniem wieloznaczności oraz uniwersalności pojęcia alibi.

The main purpose of this study is to define the institution of the alibi and define the role it plays in the Polish criminal trial. In addition, the author focuses on presenting an alibi as a way of defending the accused (suspect), and also takes into account the methods of building an alibi at every stage of the criminal proceedings. The author also describes the principles and tactics of checking alibi and gives examples of methods for checking alibi. Master's thesis is based mainly on Polish literature. The author quoted the views of representatives of forensic sciences and substantive criminal and procedural law. The author also relied on the jurisprudence developed by the Polish common courts and the Supreme Court. What is more, for the purposes of the master's thesis, the author carried out research into court files to present an alibi from the practice of Polish courts. The end of the study includes conclusions, with particular emphasis on the ambiguity and universality of the concept of alibi.
