The status of Transnistria under international law

Tematem niniejszej pracy jest status prawny Naddniestrza w świetle prawa międzynarodowego. Jej celem jest ocena powstania i istnienia nieuznanej republiki z punktu widzenia prawa międzynarodowego, w tym prawa do samostanowienia, atrybutów państwowości, nałożenia odpowiedzialności za naruszenia prawa międzynarodowego oraz wpływu podmiotów trzecich na jego formację. Praca uwzględnia również następujące zagadnienia: rys historyczny tzw. Naddniestrzańskiej Republiki Mołdawskiej, próby rozwiązania konfliktu naddniestrzańskiego, analizę aktów wewnętrznych i zewnętrznych Republiki Mołdawii i organizacji międzynarodowych. Zbadanie ww. zagadnień potwierdza egzystencję Naddniestrza jako de facto reżimu i naruszenie integralności terytorialnej Republiki Mołdawii.

The topic of this thesis is the legal status of Transnistria in the light of international law. The goal is to assess the emergence and existence of an unrecognized republic from the point of view of international law, including the right to self-determination, the attributes of statehood, the imposition of responsibility for violations of international law and influence of third parties on its formation. In the course of the work, the following issues were also considered: the historical outline of the so-called Transnistrian Moldavian Republic, the attempts to resolve the Transnistrian conflict, the analysis of internal and external acts of the Republic of Moldova and international organizations. The examination of issues in question confirms the existence of Transnistria as a de facto regime and violation of territorial integrity of the Republic of Moldova.
