Child trafficking as one of the forms of human trafficking. The example of Poland against the background of Europe after 1989

Handel ludźmi stanowi poważne zagrożenie dla współczesnej społeczności międzynarodowej. Jest brutalnym przestępstwem, które odbiera jednostkom podstawowe prawa i wolności człowieka. Ofiarą niewolnictwa XXI wieku, może stać się każdy, bez względu na kategorię wiekową, rasę czy też płeć. Szczególnie pokrzywdzonymi w tym procederze są dzieci, które ze względu na swoją niedojrzałość stanowią atrakcyjny „towar” dla przestępców. Celem niniejszej pracy jest przedstawienie zjawiska handlu dziećmi w Polsce na tle Europy po 1989 roku, na podstawie dostępnych raportów i statystyk. Kluczowa w pracy jest również charakterystyka najważniejszych podmiotów zwalczających ten proceder z uwzględnieniem oceny skuteczności polskiego systemu przeciwdziałania handlu dziećmi. Pierwszy rozdział pracy przedstawia kontekst historyczno-prawny omawianego zjawiska, jego definicję zawartą w aktach prawnych oraz podstawowe formy wykorzystywania nieletnich. Treść drugiego rozdziału opiera się na charakterystyce przestępstwa w Europie z wyszczególnieniem jego najważniejszych przyczyn. W tej części istotne jest również ukazanie instytucji europejskich, odpowiedzialnych za walkę z tym procederem. Ostatni rozdział pracy, skupia się na ukazaniu zjawiska handlu dziećmi w Polsce, z uwzględnieniem okresu po transformacji ustrojowej. W dalszej kolejności zostaną przedstawione statystyki na temat tego przestępstwa w państwie wraz z omówieniem najważniejszych organów zwalczających ten proceder. Na zakończenie zostaną przeprowadzone wnioski wraz z oceną polskiego systemu eliminowania handlu dziećmi.

Human trafficking is a serious threat to the modern international community. It is a brutal crime that deprives individuals of their fundamental human rights and freedoms. Anyone can become a victim of 21st-century slavery, regardless of age, race, or gender. Particularly affected in this process are children, who, due to their immaturity, are an attractive "commodity" for criminals. The purpose of this paper is to present the phenomenon of child trafficking in Poland against the background of Europe after 1989, based on available reports and statistics. A key aspect of the thesis is also the characterization of the main entities combating this phenomenon, including an assessment of the effectiveness of the Polish system for combating child trafficking.The first chapter of the thesis presents the historical and legal context of the phenomenon, its definition contained in legal acts, and the basic forms of exploiting minors. The content of the second chapter is based on the characterization of the crime in Europe, detailing its most important causes. This part also focuses on presenting the European institutions responsible for combating this crime. The final chapter of the thesis concentrates on the presentation of the phenomenon of child trafficking in Poland, taking into account the period after the political transformation. This will be followed by the presentation of statistics on this crime in country, along with discussion of the most important bodies combating this illigal practice. Finally, conclusions will be drawn along with an evaluation of the Polish system for eliminating child trafficking.
