Przedmiotem niniejszej pracy magisterskiej była wieloaspektowa analiza Ustawy o zawodzie psychologa i samorządzie zawodowym psychologa z 2001 r. pod względem jej wadliwości mającej negatywny wpływ zarówno na bezpieczeństwo obrotu prawnego, jak i poziom ochrony pacjentów. Motywacją do podjęcia tego tematu, były trwające prace legislacyjne nad nową podstawą prawną zawodu psychologa, a przy tym rosnące zapotrzebowanie na usługi psychologiczne o wysokim standardzie. Stan rzeczy wynikający z analizowanej ustawy stał w przeciwieństwie do potrzeb społecznych, przez ponad dwie dekady utrwalając pozorność prawną uregulowania zawodu psychologa.Do zbadania opisywanego stanu faktycznego została wykorzystana metoda case study ustawy z 2001, uzupełniona metodą dogmatyczno-prawną oraz socjologiczno-prawną. W niniejszej pracy najpierw poddano dogłębnej analizie zawartość ustawy oraz kontekst społeczny jej uchwalenia, a następnie przeanalizowano akt w perspektywie wyróżnionych koncepcji socjologicznych, takich jak m.in prawo symboliczne, placebo legislacyjne oraz prawo martwe.Analiza dokonana w niniejszej pracy pozwoliła na wysunięcie wniosku, że ustawa od początku obarczona była wieloma wadami, które znacząco utrudniały jej stosowanie w praktyce. Jednak do utrwalenia stanu faktycznego niefunkcjonowania ustawy przez ponad dwie dekady, przyczyniły się także inne procesy, takie jak nadmierne wydłużanie okresu vacatio legis oraz instrumentalizacja procesu legislacyjnego. Opisywane zabiegi, wraz z merytoryczną niedoskonałością aktów oraz nieskutecznym powołaniem samorządu zawodowego doprowadziły do trwałej pozorności instytucjonalnej i ostatecznej martwoty aktu.Opracowany stan wynikający z ustawy z 2001 r. powodował szereg negatywnych konsekwencji zarówno dla psychologów, jak i przede wszystkim dla beneficjentów usług psychologicznych (w tym osób szczególnie narażonych: niepełnosprawnych, dzieci i młodzieży). Psychologowie pozbawieni byli odpowiedniej korporacji nadzorującej ich działania, ale także reprezentującej ich interesy, a przy tym nie mieli możliwości uzyskania obowiązkowego wpisu na listę i prawa do wykonywania zawodu, co godziło w prestiż tego zawodu oraz poziom zaufania społecznego. Z kolej pacjenci pozbawieni byli środków weryfikacji uprawnień profesjonalisty oraz możliwości wyciagnięcia konsekwencji wobec osób prowadzących leczenie w sposób niewłaściwy, co stanowiło realne zagrożenie dla zdrowia i życia.Ostatecznie analiza ustawy z 2001 r. pozwoliła na postawienie tezy, że w Polsce nie ma odpowiednich mechanizmów kontroli i przeciwstawienia się systemowej bezczynności, w sytuacji istnienia ustawy, lecz jej niefunkcjonowania w praktyce.Nowa Ustawa z dnia 23 stycznia 2026 r. o zawodzie psychologa oraz samorządzie zawodowym psychologów, która ma wejść w życie 1 stycznia 2027 r., daje nadzieje na przerwanie stanu prawnej pustki, lecz wnioski poczynione w niniejszej pracy stanowią punkt odniesienia do oceny nowych rozwiązań ustawowych i są początkiem rozważań nad wzmocnieniem odpowiedzialności administracji publicznej za ustawy wdrożone, a niefunkcjonujące w praktyce.
The subject of this Master's thesis was a multi-faceted analysis of the 2001 Act on the Profession of Psychologist and Professional Self-Government in terms of its defectiveness, which negatively impacted both legal certainty and the level of patient protection. The motivation for choosing this topic was the ongoing legislative work on a new statutory basis for the psychologist profession, combined with the growing demand for high-standard psychological services. The state of affairs resulting from the analysed Act stood in direct opposition to social needs, reinforcing the legal illusion of regulating the profession for over two decades.To examine the described factual situation, the case study method of the 2001 Act was employed, supplemented by dogmatic-legal and socio-legal approaches. This thesis initially subjects the content of the Act and the social context of its enactment to an in-depth analysis, followed by an evaluation of the legislative act through the prism of specific sociological concepts, such as symbolic law, legislative placebo, and dead letter.The analysis conducted in this thesis allowed for the conclusion that the Act was burdened with numerous flaws from the very beginning, which significantly influenced its application in practice. However, other processes, such as the excessive extension of the vacatio legis period and the instrumentalization of the legislative process, also contributed to maintaining the state of non-functioning Act for over twenty years. These mechanisms, along with the imperfection of the legal provisions and the failure to establish a professional body, led to a permanent state of institutional facade and the ultimate deadness of the Act.The resulting situation under the 2001 Act caused a series of negative consequences both for psychologists and, above all, for the beneficiaries of psychological services (including particularly vulnerable groups, such as individuals with disabilities, children, and adolescents). Psychologists were deprived of an appropriate regulatory body to oversee their practices and represent their professional interests; moreover, they were unable to obtain the mandatory registration and the formal right to practice, which undermined the prestige of the profession and the level of public trust. Concurrently, patients lacked the means to verify a practitioner’s credentials or to hold accountable those who conducted treatment improperly, posing a real threat to public health and life.Ultimately, the analysis of the 2001 Act allowed for the formulation of a thesis that Poland lacks adequate control mechanisms to counter systemic legislative responsibility in scenarios where an act formally exists but fails to function in practice.The new Act on the Profession of Psychologist and Professional Self-Government of 23 January offers hope for ending this state of administrative violations.Nevertheless, the findings obtained in this thesis serve as a point of reference for evaluating the new solutions and mark the beginning of a broader discussion on strengthening the accountability of public administration for enacted yet practically non-functioning legislation.
