The dynamics of polish juridical field – structures of power and symbolic violence in legal system

Praca przedstawia model funkcjonowania polskiego pola prawnego opisanego przy pomocy teorii Pierre’a Bourdieu i późniejszego jej rozwinięcia autorstwa dr. Hanny Dębskiej na podstawie przeprowadzonych badań jakościowych. Do zebrania materiału empirycznego posłużyły techniki wywiadów eksperckich oraz obserwacji uczestniczącej na terenie sądu rejonowego w Krakowie. Praca obejmuje opisanie relacji władzy i oddziaływania przemocy symbolicznej pomiędzy aktorami w polu prawnym składającymi się na strukturę pola. Analiza zebranego materiału pozwoliła na postawienie hipotezy, że czynnikiem strukturyzującym relacje pomiędzy aktorami działającymi w polu prawnym jest odmienne rozumienie pojęcia sprawiedliwości. Jednocześnie zebrany materiał wskazuje na konieczność stworzenia teoretycznego podziału koncepcji pola prawnego, na dwa oddzielne sub-pola, z których jedno obejmowałoby prawo stanowione, a drugie orzecznictwo.

The paper presents a model of the functioning of the Polish legal field described using Pierre Bourdieu's theory and its later development by Dr. Hanna Dębska, based on qualitative research. Expert interviews and participant observation techniques were used to collect empirical material at the district court in Krakow. The paper includes a description of power relations and the influence of symbolic violence among actors within the legal field that make up the field's structure. The analysis of the collected material allowed for the hypothesis that the structuring factor of the relations between actors operating in the legal field is the different understanding of the concept of justice. At the same time, the collected material indicates the necessity of creating a theoretical division of the concept of the legal field into two separate sub-fields, one encompassing statutory law and the other jurisprudence.
