Concerning administrative law aspects of name and surname giving.

Celem niniejszej pracy jest szczegółowe omówienie aspektów nadawania oraz zmiany imion i nazwisk. Pierwszy rozdział dotyczy genezy imion i nazwisk oraz ich znaczenia w administracji. W rozdziale tym znajduje się definicja imienia oraz nazwiska. Ponadto, w pierwszym rozdziale znajduje się historia imion, oraz zjawiska społeczne, które mają istotny wpływ na wybór imienia takie jak: tradycje rodzinne, tradycje klas społecznych, oraz tradycje narodowe. Drugi rozdział skupia uwagę na znaczeniu prawnym źródeł imion i nazwisk. W rozdziale tym znajduje się opis nadania oraz zmiany imienia i nazwiska. Scharakteryzowano jak wygląda wpis imion i nazwisk w aktach stanu cywilnego. W rozdziale tym, została przeprowadzona analiza osób, które mają uprawnienie do zmiany nazwiska. Rozdział trzeci poświęcony jest regulacji prawnej administracyjnej zmiany imion i nazwisk w ujęciu historycznym. Rozdział ten składa się z dwóch podrozdziałów. Pierwszy dotyczy okresu międzywojennego a drugi okresu powojennego. W rozdziale trzecim przedstawiona została analiza dziejów kształtowania się polskich nazwisk. Czwarty rozdział pracy to: „ Wybór nazwiska lub imienia a przysposobienie”. W rozdziale tym scharakteryzowano instytucję przysposobienia. Ponadto w poszczególnych podrozdziałach, opisano kwestię wyboru nazwiska i imienia przysposabianego w poszczególnych rodzajach przysposobień. W ostatnim, piątym rozdziale została dokonana analiza postępowania administracyjnego w sprawach nadania oraz zmiany imienia i nazwiska. Znajduje się opis postępowania administracyjnego, oraz norm procesowych. W rozdziale tym znajdują się przyczyny uprawniające do zmiany imion i nazwisk. Został wskazany zakres podmiotowy uprawnionych do zmiany. Została opisana procedura zmiany imienia i nazwiska. W omawianym rozdziale zostały zamieszczone informacje dotyczące właściwości organów. Wskazano, kto może być stroną postępowania, które dotyczy zmiany imion i nazwisk. Przedstawiono cały przebieg postępowania. Na koniec scharakteryzowano wydanie decyzji w postępowaniu dotyczącym zmiany imienia lub nazwiska.

The object of this thesis is the detailed describtion of the aspects of name and surname giving and changing. The first chapter is dedicated to the genesis of the names and surnames and their meaning in administration.In tis chapter, there is the definition of the name and surname.Moreover, there is the history of the names and social occurences which influence the choice of the name like: the family traditions, the traditions of the social classes and the national traditions. The second chapter is about the legal meaning of the origin of the names and surnames. In this chapter there is the description of the name and surname giving and changing.There is the report of names and surnames registration on the certificates of personal status. There is the analisys of the people who are in the right to change the surname. The third chapter portrays the legal regulation of the administrative change of the names and surnames in the historical expression. This chapter consist of two subsections.The first concerns the interwar period and the second the post-war period. The chapter presents the analisys of the history of forming the polish surnames. The fourth chapter is: The chice of name or surname versus adaptation. This chapter depicts the institution of the adaptation. Furthermore in the particular subsections, there is the description of the matter of the choice of the adapted name and surname in the particular kinds of adaptations. The last, fifth chapter contains the analisys of the administrative procedure in the cases of the name and surname giving and changing.There is the specification of the administrative procedure and the legal norms. There are listed the reasons qualifying for changing the names and surnames.The subjective scope of those entitled to change was discussed. The procedure of the change of the name and surname was discussed. The informations about the characteristics of the administrative powers are enclosed in this chapter. It is explained who can be the party in administrative proceeding that concerns the change of the names and surnames. The total process of legal proceedings was characterised. Finally, the issuance of a decision in the proceeding concerning the change of the name or surname was depicted.
