Protection of national minorities' rights in the EU Law

Praca analizuje instrumenty, jakie szeroko pojęte prawo Unii Europejskiej dysponuje i może służyć w celu ochrony praw mniejszości narodowych. Pierwszy rozdział opisuje genezę ochrony praw mniejszości narodowych, ich definicji, liczebność w UE oraz podstawowe postulaty. Rozdział drugi analizuję unijną politykę antydyskryminacyjną z uwzględnieniem dyrektywy 2000/43 i przeciwdziałaniu dyskryminacji na tle rasowym i etnicznym. Trzeci rozdział opisuje rolę UE w ochronie mniejszości narodowych - kryteria akcesyjne, kompetencje, miejsce mniejszości narodowych w politykach sektorowych. w kontekście uprawnień wynikających z obywatelstwa UE opisany jest mechanizm Europejskiej Inicjatywy Ustawodawczej z przywołaniem dwu projektów odnoszących się do zabezpieczenia praw mniejszości narodowych. Pod koniec wzmiankowana jest szczególna sytuacja mniejszości romskiej i polityka UE prowadzona względem niej.

The thesis analyses the tools offered by the EU law in its broader sense for the protection of the national minorities’ rights. The first chapter describes the genesis of the protection of national minorities' rights, their definition, their population in the EU and their basic demands. The second chapter analyses EU anti-discrimination policy, taking into account Directive 2000/43 and the policy against racial and ethnic discrimination. The third chapter describes in particular the role of the EU in the protection of national minorities in context of accession criteria, EU competences, role of national minorities in EU sectoral policies. In the context of the rights deriving from EU citizenship, the mechanism of the European Legislative Initiative is described, with reference to two recent projects related aimed at safeguarding the rights of national minorities. Finally, the specific situation of the Roma minority and the EU policy pursued towards them is mentioned.
