Position of public prosecutor in civil procedure

Niniejsza praca porusza problematykę udziału prokuratora w postępowaniu cywilnym. Obecnie polskie rozwiązania prawodawcze przyznają prokuratorowi także pewne kompetencje poza procesem karnym. Zainteresowaniem autora objęty jest sądowy proces cywilny, uregulowany przede wszystkim w kodeksie postępowania cywilnego, ale także i w ustawach szczególnych. Pozycja prokuratora w postępowaniu cywilnym jest bardzo doniosła. Pełni on rolę rzecznika interesu publicznego, strzeże praworządności i interesów obywateli. Rozdział I zawiera omówienie pozycji ustrojowej prokuratora w RP w ogólności oraz teoretyczne modele udziału prokuratora w postępowaniu cywilnym. Rozdział IIzawiera regulacje dotyczące udziału prokuratora w postępowaniu cywilnym na bazie kodeksu postępowania cywilnego. Omówione zostały przepisy ogólne (7, 55-60 k.p.c.) oraz sprawy rodzinne, skarga kasacyjna Prokurator Generalnego, obligatoryjny udział prokuratora w postępowaniu o ubezwłasnowolnienie i postępowanie egzekucyjne. W rozdziale III poruszono wybrane kwestie z ustaw szczególnych: sprawy z zakresu akt stanu cywilnego, zdrowie psychiczne i sprawy nieletnich. Rozdział IV omawia unieważnienie orzeczenia przez Sąd Najwyższy.

This thesis deals with public prosecutor’s activity in civil procedure. Pursuant to the laws of the Republic of Poland, the prosecutor’s office has been granted with certain competencies outside the criminal field. Author’s attention is focused on judicial civil procedure, regulated in principle the Code of Civil Procedure (k.p.c.) and also in specialized acts. Position of the public prosecutor in the Polish civil procedure is of very high significance. He protects the public interest, law and order.Chapter I describes generally the position of the public prosecutor under the Polish legal system and theoretical models of his activities in civil procedure. Chapter II deals with regulations regarding prosecutor’s activity in civil procedure on the basis of the Code of Civil Procedure. This chapter provides a summary of general regulations (7, 55-60 k.p.c.), family cases, cassation appeal of the General Prosecutor, obligatory prosecutor’s activity in the proceedings concerning incapacitation and executive procedure. Chapter III covers chosen specialized regulations: public registry records, psychical health and juvenile cases. Chapter IV describes invalidation of judgment by the Supreme Court as a result of brining legal action by the General Prosecutor.
